This letter is to confirm action taken by the Frederick County Board of Zoning Appeals at their
meeting of September 17, 1991
Application #011-91 was approved for a 2.6' side yard and a 34' front yard variance for a
house. Application #013-91 was approved for a lot size of 4.604 acres rather than the required
5.0 acres.
This property is located in the Opequon Ridge Subdivision on Hummingbird Lane in the
Stonewall District and is identified by Geographic Parcel Identification number 45000050200017.

REASON FOR VARIANCE: Survey in May, 1991 revealed that a portion of
the supposedly 5.459 acre lot actually only contained 4.604 acres
since there was an apparent overlap with the adjoining property to
the north.
STAFF COMMENTS: This error occurred through no fault of the
owner/applicant and he is agreeable to relinquish the 0.855 acre
portion of his lot to the adjoining property owner. This will
reduce his lot size below the five acre minimum but will have no
impact on the neighborhood.

I (we), the undersigned, do hereby respectfully make
application and petition the Frederick County Board of Zoning
Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick Co. officials
to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed at the front property line at least
seven (7) days prior to the BZA public hearing and maintained so
as to be visible from the road or right-of-way until the hearing.
