meeting of September 17, 1991
Application #011-91 was approved for a 2.6' side yard and a 34' front yard variance for a
house. Application #013-91 was approved for a lot size of 4.604 acres rather than the required
5.0 acres.
This property is located in the Opequon Ridge Subdivision on Hummingbird Lane in the

STAFF COMMENTS: The side yard violation could have been
prevented with a more careful citing of the house. App=icanz has
advised zhaz he thought the front setback requirement was from the
center of the road right-of-way vice the edge of the right of way.
There was an additional problem with locating the house in relaticr_
to the septic system but this could have been overcome with proper
engineering.
STAFF RECOMMENDATION: Since most or all of the other homeowners in
this subdivision have no objection and the house has already been
constructed, recommend approval.

Because of the topography of the land, there was only one
place to set the septic field.Because of the shape of the
property (pie -shaped) this made necessary to place the house
12.4 feet from the property line and 62feet from the road.

The closest house is over 150 feet away. I have approached
every neighbor in the subdivision in regards to the placement
of the house. Evervone has azreed to the,..Dlacement without
any objection.

AGREEMENT
I (we), the undersigned, do hereby respectfully make
application and petition the Frederick County Board of Zoning
Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick Co. officials
to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed at the front property line at least
seven (7) days prior to the BZA public hearing and maintained so
as to be visible from the road or right -of -way -until the hearing.
