REASON FOR VARIANCE: House and deck were.built in the rear setback zone in violation of the zoning ordinance. STAFF COMMENTS: The building permit for this house was approved with a 60 foot rear setback and the plat that was submitted showing the house location actually indicates that the house was to be built squarely on the lot and at the proper setbacks. The actual house location is at an angle on the lot and the front setback is much greater than the listed 35 feet. The house appears to have been placed further back on the lot to get out of the steep front slope. The angle at which it was placed slightly impacts the rear setback violation but ds not the sole reason for same. The rear of this property abuts a large open space in the development and it does not appear to be drastically out of character with the neighborhood. RECOMMENDATION: Approval.
