Board of Zoning Appeals at their meeting of April 16,-1991.
Your variance application #004-91 was approved for a 19' rear

VARIANCE: Nineteen foot rear variance for an existing house and
deck.
REASON FOR VARIANCE: House and deck were.built in the rear setback
zone in violation of the zoning ordinance.
STAFF COMMENTS: The building permit for this house was approved
with a 60 foot rear setback and the plat that was submitted showing
the house location actually indicates that the house was to be
built squarely on the lot and at the proper setbacks. The actual
house location is at an angle on the lot and the front setback is
much greater than the listed 35 feet. The house appears to have
been placed further back on the lot to get out of the steep front
slope. The angle at which it was placed slightly impacts the rear
setback violation but ds not the sole reason for same. The rear
of this property abuts a large open space in the development and
it does not appear to be drastically out of character with the
neighborhood.

Appeals (BZA) to grant a variance to -the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.

and between GLEN E. RUSSELL and JUDY S. RU ELL, his wife,
hereinafter called the Grantors, and RONALD W. STROSNIDER and
CATHY W. STROSNIDER, his wife, hereinafter called the Grantees.
WITNESSETH: That in consideration of the sum of Ten
Dollars, ($10.00) and other valuable considerations paid the
Grantors by the Grantees on or before the delivery of this Deed,

attached to the Deed of Dedication of said Subdivision,
dated June 1, 1987, recorded in the Clerk's Office
of the Circuit Court of Frederick County, Virginia,
in Deed Book G49, at Page 697, et seq. and by this
reference made a part hereof as if set out in full.
This is the same property which was conveyed to the
Grantors by Shiho, Inc., a Virginia Corporation,
t/a Lakeside Development, by Deed dated March 9, 1988,
and recorded in said Clerk's Office immediately
preceding and contemporaneously with this Deed.
