Board of Zoning Appeals at their meeting of March 19,.1991. .
Variance application #002-91 of Edward L. Chapman was approved for
a five and one half foot right side yard variance for an attached
storage building. This property is located off of Route 277 at 282
Overview Court in the Opequon Magisterial District and is
identified as parcel 70 on tax map 85C.

REASON FOR VARIANCE: Existing, attached.storage facility is too
close to the side yard property line. Applicant needs a variance
to accomodate refinancing of his home.
STAFF COMMENTS: This addition to the house was constructed without
the required building permit. Acquisition of the required permit
may have assisted the owner in avoiding this violation. This
addition to the house does not appear to have any significant
impact on the neighborhood.
RECOMMENDATION: Approval, with the condition that the applicant
acquires the appropriate building permits.

application and petition the Frederick County Board of Zoning
Appeals (BZA) to grant a variance to -the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick Co. officials
to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed at the front property line at least

19852 by and between J & J BUILDERS, INC., a Virginina Corporation, party
of the First part, hereinafter called the Grantors and EDWARD L. CHAPMAN
and DEBORAH G. CHAPMAN, his wife, party of the Second part, hereinafter
called the Grantees.
WITNESSETH: That for and in consideration of the sum of Ten
Dollars ($10.00), and other good and valuable consideration, receipt whereof
is hereby. acknowledged, the Grantors do hereby grant, and convey with
general warranty and English covenants of title, unto the Grantees, in
fee simple, jointly, as tenants by the entirety with the common law
right of .survivorship, the following described property:
All of that certain lot or parcel of land lying
and being situate in Opequon Magisterial District
Frederick County, Virginia, on the South side of
Overview Court, and being in all respects the same
land designated Lot 70, containing 12,467 square feet,
on the plat of Ridgefield Subdivision, Section Two,
duly recorded in the Office of the Clerk of the Circuit
Court of Frederick County, Virginia in Deed Book 530, beginning
at Page 274, and being the same property conveyed to
J & J Builders, Ine.,.a Virginia Corporation, from
Harry F. Stimpson, Jr., et al, by Deed dated May 7, 1985
and on record in the Clerk's Office of the Circuit
Court of Frederick County in Deed Book 594 at Page 639.
Reference is made to the aforesaid plat and deed for a further
and more particular description to the realty hereby conveyed..
This conveyance, however, is made subject to all rights of
ways, easements and/or conditions of record, if any, affecting the
aforesaid realty.
The Grantors do hereby covenant that they have the right
to convey said realty to the Grantees, that the Grantees shall have
quiet and peaceable possession of the said property, free from all
liens and encumbrances; and that they will grant such further assurance
of title as may be requisite.
