NUMBER: 74B000100000000200830 PROPERTY ZONING & USE: Zoned RP (Residential Performance), land use - Residential ADJOINING ZONING & USE: Zoned RV'(Residential Performance), land use - Residential VARIANCE: Three foot variance on the left side and a one foot rear variance for a storage building REASON FOR VARIANCE: Exceptional narrowness and shape of the property and location of utility pole guy wires makes it difficult to fit a storage building on the property with the standard setbacks. STAFF COMMENTS: Accessory structures in the RP district require five foot setbacks from the rear and side property lines. This structure has already been placed on the property as indicated on the applicant's diagram, although no building permit has been obtained. A smaller building would have been able to meet the setback requirements and provide reasonable work/storage space. This building is more substantial than most storage buildings. The building is in a reasonable location, considering the shape of the property and location of utility pole guy wires. Although it is possible to put the building at a different place on the property and meet the required setbacks, the building would then be towards the middle of the back yard, interfering with the use of the back yard for this residence and the view through the back yard for the neighbors. This would not be a particularly significant variance to the normal requirements, but it is not altogether clear whether granting it would impose any hardship on neighboring properties. The roof comes fairly close to lot 82, creating potential run-off problems 0 Ricker Variance Page -2- for that lot. RECOMMENDATION: Approval, if not opposed by adjoiners, with the following conditions: 1. That a valid building permit and occupancy permit be obtained within one month of the granting of this variance. 2. That, gutters and downspouts be maintained on the structure so that no run=off is imposed on neighboring properties.
