As a property owner within West Side Station (2016 Colin Drive) would you kindly forward the following comments to the Board of Zoning Appeals, as I will not be able to attend today's meeting. It is my understanding zoning variance is being requested for front set back on two lots and front and fear set back on one lot. My first comments are that set backs should have been taken into account when original subdivision took place and was approved. Secondly, there are restrictions within West Side Station as to size of homes placed on subject lots. Single level home must have a minimum of 1,600 sq. ft. of finished living space, while a two story home must have a minimum of 1,000 sq. ft. of finished living space per floor (totaling 2,000 sq. ft of living space). Thirdly, as the adjacent property owner of the lot located at the corner of Colin Drive and Colin Court I am concerned that granting any front, side or back variances on the proposed lots will set a precedent which will later directly impact my property, when set back variances are applied for on the lot adjacent to mine. In closing I would like to suggest to the Board of Zoning Appeals that they decline granting of set back variances (As proposed by TIBOW) and recommend they take the three existing lots and re -subdivide them into two lots. This should allow a large enough foot print for construction of the required size houses without any set back variances. Thank you for your consideration in this matter. Best Regards Henn L. LOCATION: The property is located at Westside Station, Section 2 (Lot 15). USE: Zoned RP (Residential Performance); Uses: Residential and Vacant VARIANCE: The applicant is requesting a five-foot front yard and five-foot back yard setback variance to construct a single-family residence. REASON FOR VARIANCE: The odd configuration on this cul-de-sac lot and the shallowness of the same does not allow for a proper building area that is in conformance with restrictive covenants (1,600 square feet on one story and 2,000 square feet on two story.) STAFF COMMENTS: Within the RP (Residential Performance) Zoning District, the minimum front yard setback for a principal structure is 35 feet, while the minimum rear setback is 25 feet. The applicant is requesting a five-foot front yard variance, as well as a five-foot rear yard variance to construct a single family home. The subject property is an 8,119-square foot lot which lies on a cul-de-sac at the terminus of Colin Court. The parcel is bordered by a 50-foot storm sewer easement to the north/northeast. The parcel to the northwest is vacant, while Colin Court lies to the immediate west. The parcel to the immediate south is a single family residence. The proposed dwelling has a ground floor area of 1,380 square feet. The subject parcel (Lot 15) shares the 84-foot property boundary referenced in Variance # 09-00. Likewise, the configuration of the lot creates a limited building area. In comparison with surrounding lots, this parcel is 500 square feet less in area. The limited lot area, coupled with the usual configuration of the lot, create the need for both a front and rear yard variance. Tibow, L.L.C. - Lot 15 Page 2 July 10, 2000 STAFF CONCLUSION: The Code of Virginia, Section 15.2-2309(2) states that no variance shall be authorized by the board unless it finds that a) strict application of the Ordinance would produce an undue hardship approaching confiscation; b) that such hardship is not shared generally by other properties in the same zoning district and the same vicinity, and; c) that the authorization of such variance will not be of substantial detriment to adjacent property, and that the character of the district will not be changed by the granting of the MAJOR "1_LKM Staff is of the opinion that the requested variance satisfies the aforementioned criteria. Indeed, the subj ect property is affected by unusual conditions which preclude conformance with all applicable setback standards. To strictly apply the setback standards in this case would produce a hardship approaching confiscation of the property.
