The applicant sought this variance as a remedy to a zoning ordinance violation regarding building setbacks. It appears that the violation was the result of a third party inspector's failure to confirm survey setbacks prior to authorizing the pouring of the concrete foundation. Records indicate that Ruckman Engineering conducted the third party inspections for this project. The BZA has received three setback variance requests over the past 14 months for similar setback violations identified through the survey standard process. Each of these projects utilized Ruckman Engineering as the third party inspector; and each project would have avoided the zoning ordinance violation, and the ensuing request to the BZA, had the established survey standards process been followed. In the future, we hope that you are more cautious when acting as the third party inspector for construction projects. A primary responsibility of the BZA is to consider when County Zoning Ordinance requirements place an undue hardship on property owners. The failure of a third party inspector to satisfactorily conduct an inspection is not an example of an undue hardship, and will not be accepted as justification for setback variances on future variance requests. I trust you will be more thorough in the future so your clients are not positioned in need of a variance to remedy your oversight. Sincerely, Mr. James R. It was brought to my attention by you in our recent phone conversation that the foundation that is constructed to this point was inspected by your company pending your receipt of the survey setback report showing the approved location of the structure. Please be aware that if inspection approvals were granted prior to receipt of the survey setback report than your firm violated the Frederick County Code section 165-23 (2) and the Third Party Inspection Policy was not adhered to. Our records indicates that on November 2, 2000 inspection tickets were submitted for this project showing an approval of the footing inspection on September 9, 2000 and approval of the -wall inspection on September 13, 2000 however, the survey setback sealed report has not been forwarded. The requirement is stated within our policy under item 94 (A) All third parry inspections shall be documented in writing and presented to the Building Code Official within five calendar days after performing the inspections. The County Code under section 165-23 (2) states the first completed setback verification ticket shall be obtained form the permit holder or their on -site representative by the inspector performing the footing inspection and returned to our office as part of the approval. It is of the utmost importance that all of the guidelines set forth within our policy shall be followed. Conformance to these polices will insure that construction projects within Frederick County comply with all State and County Codes and that stopping work on projects after permits are issued are kept to a minimum. Failure to comply with established procedures and policies shall result in the appropriate action being taken to assure proper information is obtained prior to the approval of structure placement. REASON FOR VARIANCE: See Attachment submitted by the applicant. STAFF COMMENTS: The required setback of a side boundary line in the (RA) Rural Areas Zoning District is 50 feet when adjoining a residential property. In this request for a variance, the applicant desires to build a single-family dwelling as close as 45.14 feet to the right boundary line, a difference of 4.86 feet from the required distance. The property is located in the Back Creek District, with just under 200 feet of road frontage along Rt. 600. The surrounding lots are residential or vacant, and the entrance to Mountain Falls Park, or Wild Acres, is approximately 2/10 of a mile north of the property. The property in question is typical in size for the area, 12.863 acres to be exact. The lot is a pipestem lot, however, meaning the lot is much wider on one side than the other. Despite this, the front portion of the lot is wide enough to construct a house within the building restriction line. On August.29, 2000, the staff approved the house with a setback of 55 feet on both the right and left sides. A building survey was required as a condition to the permit because the structure was proposed at a location within five feet of the minimum setback requirement. It is unclear exactly why the foundation of the house was built at a slightly different location than approved; however, the error is most likely to have occurred due to a mistake by a third party building inspector. A county building inspector discovered the discrepancy on October 12, 2000. Currently, a stop -work order has been David Nutter Variance Page 2 November 9, 2000 STAFF CONCLUSION: The Code of Virginia, Section 15.2-2309(2) states that no variance shall be authorized by the board unless it finds that a) strict application of the Ordinance would produce an undue hardship approaching confiscation; b) that such hardship is not shared generally by other properties in the same zoning district and the same vicinity, and; c) that the authorization of such variance will not be of substantial detriment to adjacent property, and that the character of the district will not be changed by the granting of the variance. After an inspection of the property, an analysis of the Zoning Ordinance, and in consideration of the circumstances, the staff is of the opinion that this request for a variance be denied. The three primary reasons for this recommendation are as follows: 1. Although it is unfortunate that the foundation of the house has already been built, there is no undue hardship, approaching confiscation, directed toward the owner. Furthermore, there is adequate room to build the house if located closer to the left boundary line. The required setbacks were made clear when the building permit was approved. 2. Other lots in the area are subject to the same setback requirements when constructing a primary structure. 3.
