VARIANCE: Requesting a 7' side yard variance for an addition.
REASON FOR VARIANCE: The applicant needs the above referenced variance in order to
provide a required addition to Sherando High School.
STAFF COMMENTS:
A policy decision was enacted by elected officials that required the Frederick County School
Board to increase the enrollment capacity of the two county high schools from 1,250 students to
1,500 students. In order to accomplish this directive, a minimum square footage is required to be
added to each high school. The Sherando High School campus is developed in a fashion that
requires the additional building square footage to be located on the south side of the building.
Unlike the James Wood High School addition, the existing Sherando High School does not allow
for the addition of a two story structure. - Therefore, the necessary footprint of the structural
addition is limited in location and height.
Two adjoining properties are impacted by this variance request. These properties are owned by

Sherando High School Variance
George and Wanda Linaweaver and James Cooley. These properties, as well as the Sherando
High School property are zoned Rural Areas (RA) District. The minimum side yard and rear yard
setback requirement for primary structures in the RA District is 50 feet from adjoining properties
whose primary use is residential. In order for the School Board to construct the required square
footage, the new addition will be locatEd a minimum of 43 feet from the Linaweaver property and
47 feet from the Cooley property. Therefore, a seven foot maximum side yard variance is
required for this addition. The location of the exiSting residential dwellings is more than 200 feet
from the rear property line of the Sherando High School property.
Staff believes that the Sherando High School variance request meets the test for Board of Zoning
Appeals approval as specified in Section 15.1-495(b)(1),(2), and (3) of the Code of Virginia.
Strict application of the Zoning Ordinance would produce an undue hardship based on the
required square footage of the addition, and approval of the variance request will not have a
detrimental impact to adjoining properties or the Zoning District as a whole.

AGREEMENT
I (we), the undersigned., do hereby respectfully make
application, and petition the Frederick County Board of Zoning
Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick County
officials to go upon the property for site inspection purposes.
I. understand that the sign issued to me when this application
is submitted must be placed at the front property line at least

the first part, hereinafter called the Grantor, and THE COUNTY
SCHOOL BOARD OF FREDERICK COUNTY. VIRGINIA, party of the second
part, hereinafter called the Grantee, and GEORGE W. GLAIZE, JR.,

conveyed to Preston E. Conner and Delia C. Conner, his wife, by
deed dated -September 7, 1951, from H. R. Orndorff (unmarried) of
record in the Clerk's Office of the Circuit Court of Frederick
County, Virginia in Deed Book Deed Book 220 at Page 283, and
being a portion of the same land conveyed to Preston E. Conner
and De iaa C.. Conner by deed dated February 2601, 1940, from Eduard
N. Anderson, et ux, of record in the aforesaid Clerk's Office in
Deed Book 179 at Page 527, and further, being a portion of the
same land a one-half interest in which Delia C. Conner died
seized and possessed, and by final decree entered in that

certain Chancery matter on June 12, 1985, styled Preston E.
Conner, Complainant, v. James Lee Chilcott, et al, Defendants,
(In Chancery No. C-85-7) was deemed to have been devised to the
said Preston E. Conner for life with absolute power of disposal
during his lifetime. Reference is made to the aforesaid plat,
deeds, and final decree for a more particular description of
the property herein conveyed.
This conveyance is made subject to all easements,
rights of way and restrictions of record affecting the subject
property.
The Grantor does hereby grant a certain 50' right of
way along the southern boundary of the 42.5 acre retained
tract, which right of way is 50' in width and includes the
existing roadway, and which right of way shall be a public
right of way or a private right of way for the use and benefit
of the property hereinbefore conveyed to the Grantee, to be
maintained solely by said Grantee; however, said right of way
shall be used in common with the Grantor, his successors and
assigns, and shall be deemed to be appurtenant with the 42.5
acre remaining tract of Grantor; at such time as the Grantee
shall d a roadway within the boundaries of said 50' right
of way, then each of the parties hereto, their successors and
assigns, agree to dedicate in fee simple to the public, for a
public roadway, the land embraced in said 50' right of way.
The Grantor, his successors and assigns, hereby
reserve a 60' right of way along the western boundary of the
tract herein conveyed, as shown on the attached sketch, and
does hereby grant a 60' right of way to the Grantee along the
as shown on the attached plat
eastern boundary of the 42.5 acre tract retained,/ which right
of way shall be for the purpose of ingress and egress for the
land herein conveyed, and the 42.5 acre tract retained, and

further to be used in common with that certain 80' right of way
for ingress and egress to Route 277. At such time as a public
roadway is built by the Grantee within the boundaries of said
60' right of way, then each of the parties hereto, their
successors and assigns, agree to dedicate in fee simple to the
public, for a public roadway, the land embraced in said 60'
right of way, and Grantee agrees that public water and sewer
The Grantor hereby covenants that he has the right to
convey to the Grantee; that the Grantee shall have quiet and
peaceable possession of the said property, free from all liens
and encumbrances; and he will grant such further assurances of
title as may be requisite.
The parties of the third part join in the execution
of this deed to grant and convey unto the Grantee, in fee
simple, all of their right, title and interest in the property
by virtue of that certain Real Estate Sales Contract dated
December 7, 1989, of record in the aforesaid Clerk's Office in
Deed Book 737 at Page 493.
The parties of the fourth part, spouses of each of
the respective parties of the third part, join in the execution
of this deed to release and convey unto the Grantee all of
their right, title and interest, if any, in the subject
property, including their inchoate right of dower.

The accompanying plat represents a boundary survey of a portion of the land
conveyed to Preston E. Conner and Delia C. Conner, his wife, by deeds dated 26 February
1940 and 7 September 1951 and recorded among the land records of Frederick County,
Virginia, in Deed Book 179 at Page 527 and Deed Book 220 at Page 283 respectively.
The said land fronts the center of a private lane approximately 0.4 miles Southeast of
Va. Secondary Route 641 in Opequon Magisterial District, Frederick County, Virginia, and is
more particularly described by metes and bounds as follows -
Beginning at an iron pipe found by a fence post, a corner to Fruit Limited
Partnership and Grimm; thence with the said Grimm land for the two following courses:
S54051'25"E - 316.49 feet to an iron rod found; thence N36007'42"E - 372.93 feet to a
36" oak tree at the most westerly corner of the Musser land, thence with the southerly lines
of the said Musser land, Braddock Partnership land and then Fink for the three following
courses: S58033'27"E - 373.63 feet to an iron rod found; thence S58033'27"E - 164.71
feet to a fence post; thence S581119'26"E - 461.52 feet to a fence post in the westerly line
of the County of Frederick Sherando Park; thence with the said line of Sherando Park for the
three following courses: S37059'38"W - 351.18 feet to an iron rod found; thence
S38014'01 "W - 575.91 feet; thence S38032'28"W - 441.06 feet to a fence post in the
northerly line of the Clevenger land; thence with the said line of Clevenger and then Hughes,
Frye, Grady, Neff, Cooley and Linaweaver, N53006'02"W, - 968.53 feet to a fence post;
thence with the westerly line of the said Linaweaver land, S39027'28"W - 481.14 feet to
an iron rod set in the center of a private lane at the northea�Aerly corner of the Wymer land;
thence with the said center of the private lane, N51 °06'01 "W - 248.45 feet to a railroad
spike set, a corner to the remaining land of Conner; thence with two new division lines of
Conner's remaining land as follows: N32008'16"E - 1265.53 feet to an iron rod set; thence
N30041'02"E - 100.00 feet to an iron rod set in the southerly line of the said Fruit Limited
Partnership land; thence with the said line, S551129'54"E - 80.18 feet to the point of
beginning.
