First floor in the rear is 8' above grade. STAFF COMMENTS: This house was placed 5' behind the allowable front setback of 35'. Had the house been placed forward this five feet there would be no need for a variance. This, coupled with the allowance of Section 165-23 F.(3) of the Zoning Ordinance which allows a deck that is less than 1/3 the length wall of the primary structure to protrude three feet into the setback area, would have allowed the deck to be built without a variance. Applicant states in Item 13 of the application that "house being built is in keeping with houses adjacent to it. Configuration of lot did not allow much flexibility in siting house." There is no hardship because this house could have been easily placed on this lot with the deck. There is absolutely no reason to grant this variance because the hardship is self created. This, coupled with the allowance of Section 165-23F.(3) of the Zoning Ordinance which allows a deck that is less than 1/3 the length of the wall of the primary structure to protrude three feet into the setback area, would have allowed this deck to be built without a variance. Applicant states in Item 13 of the application that " house being built is in keeping with other houses adjacent to it. Configuration of lot did. not allow much flexibility in siting house." There is no hardship liec_ use thishave been placed on this lot and still. had_ adequate... area or a deck. There is absolutely no reason to grant this variance because this is a situation created by the builder.
