their meeting of September 19, 1995.
The Board of Zoning Appeals approved your application for a 5' variance for an outside
compressor room. A condition of the approval is that a $1500 bond be posted to insure that
there is a minimum of R19 insulation installed in the newly constructed room.

LOCATION: The directions to this property are as follows: Travel East on Berryville
Pike (Route 7), turn left onto Baker Lane, go approximately one mile, and turn right
onto Imboden Drive. Winchester Countertop is the last warehouse on left.

REASON FOR VARIANCE: Variance is sought for the purpose of reducing noise and
other potential problems to the employees and the facility.
STAFF COMMENTS: Currently, one compressor and a dust collection system is housed
internally and somewhat isolated in a small room. This room is not insulated or sound
proofed. One additional compressor is external to the facility in the rear. While inside
the building I could not see this unit because the door was sealed off.
Applicant stated that "the property adjacent to the proposed variance is vacant and
unimproved. No one will be adversely affected by the granting of this variance."
Although now vacant the adjacent property will probably develop at some time since it is
valuable M-1 property. Moving the compressor outside of their building could very well
impact the adjoining property when it develops. Since the applicant has stated that the
equipment is noisy, placing it closer to an adjoining property very well may cause noise
pollution on that property.

Winchester Countertop Variance
A review of the site plan presented for the development of this property shows that there
is adequate area on site to place these uses although this might not be the most
economical solution. The engineer who was involved in development of the original site
plan has indicated that it would be feasible to do this.
Since there are solutions available to accommodate the desired reconfiguration of this
facility and all avenues of possible relief have not been expended, there is no reason to
grant this variance.
STAFF RECOMMENDATION: Denial since there is no demonstrated hardship.

Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply

RE: Setback Request
Dear Sir:
Thank you for your preliminary approval of our request to
place our air compressors outside of our building. At
this time 1 will be approaching the county for approval on
the setback variance.
In regards to your request for our final plans, they are
as hollows: We are going to construct two concrete pads
b foot wide and no greater than ten feet long. The first
pad will be approximately bC) feet from the front end of
the building and the secoVd pad approximately .30 feet from
the rear of the building. These enclosures will conform
to the existing structures and will be properly insulated
to reduce the potential noise to the outside environment.
Based upon current expectations 1 believe that these items
will be completed in approximately 2-_► months time
depending upon approval from the county.

Re: Property Set Back Variance Request
Dear Mr. Mc Farland:
We are in receipt of your telefax dated 6/28/95 that shows a rough sketch of the building
addition that you wish to construct. It is our. understanding that you would like to build
two, small• enclosures (approx. 5' x 5 `) to house air compressors.. These enclosures will
extend from your building to within 21' of our property line; which is four feet beyond
the required 25' set back.
We have reviewed this information and are willing to give preliminary approval to this
variance. We will want to review your final plan for these additions, prior to the submittal
to the county.
We anticipate that this addition will be consistent with the current architecture of your
building. Also, we hope that this structure will be properly insulated to reduce the exterior
noise from these compressors.

Dear Greg:
I have reviewed the air compressor unit located in the building. The compressor is a possible
source of ignition for the sawdust and adhesive used in your manufacturing process, It is also a
source of heat to which the employees would be exposed on'a daily basis. To reduce the
possibilities of the electric motor on the compressor igniting the sawdust or the adhesive, the
Compressor unit should be relocated to a position outside of the building;
