VARIANCE: Requesting a 10.4' side yard variance for an existing home.
REASON FOR VARIANCE: Builder constructed the house 74.6' from the side property line
thinking that he had more than enough for the 60' side line restriction, not realizing that he
had to be 60' from the edge of the right of way for Panarama Drive.
STAFF COMMENTS: The house was required to have a 60' right side yard setback since
this is a corner lot and the right side borders on a street or right of way. The approved
building permit for this house listed the correct right side yard setback, but the builder
measured from the center of Panarama Drive, which is a 50' right of way, rather than
measuring from the edge of the right of way which is what is required.
STAFF RECOMMENDATIONS: Approval as requested.

AGREEMENT

application, and petition .the Frederick County Board of Zoning
Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick County
officials to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed at the front property line at least
seven (7) days prior to the BZA public hearing and maintained so as
