REASON FOR VARIANCE: The house and deck, which were built years ago, extend into a road efficiency buffer area. The applicant wishes to sell the home, but must first bring the house into compliance. STAFF COMMENTS: Chapter 165-37 of the Frederick County Ordinance states that residential structures must be constructed 80' from a collector road. (See attached sheet) This distance between homes, collectors, arterial, or interstate roadways are defined as "road efficiency buffers." The purpose of the buffer requirements is to help maintain a quiet, safe, and pleasant atmosphere expected in a residential area, by keeping residential structures at a reasonable distance from major roads. It also facilitates a safe and pleasant viewshed while traveling along the County's roads. The applicant is not suffering from a hardship due to a change in regulations. The requirements for road efficiency buffers were set in place prior to the construction of the home in 1986. In addition, the building restriction line, which reflects the road efficiency 0 0 Page 2 Molden Real Estate Variance buffer on all the lots along Senseny Road, was clearly indicated on the Glemont's subdivision plan in 1984. On the plan, the road buffer is indicated to be 100 feet. Due to the shape of the building footprint on this particular lot, however, it is reasonable to grant a variance for the existing home. The curvature of road, cuts into the building lot reducing its buildable shape. The extent of this reduction is not shared by other residents along the street. It is also reasonable to apply the current standards of the 80' road buffer. This brings the existing residential home in compliance and will allow for an attached deck. The existing shed, however, should be removed or relocated to meet the 80' buffer.
