REASON FOR VARIANCE: The applicant states that the property was initially surveyed to place a home meeting side yard setbacks. Evidently the wall forming crew moved the pins and didn't set forms correctly therefore causing the house to be mislocated. STAFF COMMENTS: Chapter 165, Section 65 of the Frederick County Zoning Ordinance describes the setbacks for single family detached dwellings. The minimum setback for a side yard is 10 feet. Strict application of the ordinance did not restrict the applicant from utilizing the property for a residence. The regulations did not restrict the applicant from building the size and type of home he intended. Instead, a variance is sought to relieve a self-inflicted hardship caused by a negligent oversight. A self-inflicted hardship, accidental or not, is no basis for granting a variance.
