VARIANCE: A 25' height variance from the allowed 35' maximum height requirement.
REASON FOR VARIANCE: The applicant wishes to construct a church that will include
handicap access from the ground floor, a main sanctuary of the' first floor, a balcony area
on the second floor, and a rising peak roof. The design of the church can not be
accommodated in a structure limited to 35 feet in height.
STAFF COMMENTS: The height limitations within RA (Rural Area), Zoning District is
35 feet. In this case, the applicant wishes to construct a church that includes a mezzanine
and an open peaked roof. The height of the proposed building is 56 feet from the basement
level to the peak of the roof.
The Planning Staff has consulted with the County's Inspections Department and the
Department of Fire and Rescue about any problems that the additional height may cause.
The Inspections Department stated that the additional height was not a concern provided
they meet building code regulations. The Department of Fire and Rescue stated their
concerns have been adequately addressed by the architect in the building design (see
attached letter).

Although the additional height of the proposed church would not cause negative effects on
the surrounding property, the applicant has not presented a case of undue hardship. An
alternative design could be drafted to meet the required 35' height requirement as specified
by the Code of Frederick County.
STAFF RECOMMENDATIONS: Staff recommends denial.

On April 26, 1995, I met with the architect and members of
Redland United Methodist Church regarding their request for a
height variance in an RA Zone.
The concern the fire department has about building heights
is our ability to rescue persons with ladders and the ability to
ventilate a structure by "opening up" the roof. Typically, our
engine companies can effectively operate to heights of 28' to 30'
with the ground ladders they carry on their apparatus. Beyond
that, an aerial ladder is required for rescue and ventilation.
The proposed church building for Redland U.M.C. will only be
occupied one story above grade access so the fire department's
ability to make immediate rescue is not a concern.
To facilitate ventilation, the architect is going to
incorporate automatic smoke vents in each end of the building at
the apex of the roof at the highest level of the roof. These
vents will either be activated by smoke detectors or can be
manually opened from the Fire Alarm Control Panel (FAC) located
in the main lobby area, by fire dept. personnel. The structure
could then be ventilated via "positive pressure" fans placed at
the grade level.
Further, the church members said that there will be adequate
access for a ladder truck on three sides of the building if it
were necessary to deploy such a piece of apparatus on an incident
at this facility.
The Fire and Rescue Dept. is very supportive of the 30'
height restriction in the RA Zone as it allows us to address
taller structures on a case by case basis.

In this instance, the owners and designers have adequately
addressed the concerns our department have about a 60' structure
so we support their request for a height variance.
Items such as fire lanes and emergency vehicle access will
be addressed on the site plan when that stage of the process is
submitted for review.
