their meeting of April 18, 1995.
The Board of Zoning Appeals approved your application for a 14.3' rear yard variance to
rectify the structures's current status of failing to meet the required setback of 25', and a 3'
side yard variance to accommodate for steps constructed on the left side of the -structure to
access your deck.

LOCATION: This property is located at 100 Van Buren Court, Winchester, Virginia.
Directions to this property are as follows: traveling on Valley Mill Road (Route 659), make
a right onto Cloverdale Court, then a left onto Pebblebrook Lane, and then a right onto
Van Buren Court.

VARIANCE: A 14.3 foot rear yard variance to be in compliance with the code and a 3 foot
left side variance.
REASON FOR VARIANCE: The applicant is requesting a rear and side yard variance to
be in compliance with the code. Due to the fact that the house was built too close the
property line and access to the front of the house is needed, the applicant feels this is the
best way to address the situation.
STAFF COMMENTS: Structures built within the Brentwood Terrace subdivision have to
meet front and rear setbacks of 25 feet. At the time the applicant's home was constructed,
it was determined that the front yard faced Pebble Brook Lane, which left an adequate side
yard setback of 10 feet. The structure number or address of the home, however, is Van
Buren Court, in which it faces. Given that the front yard faces Van Buren Court, the rear
yard, (which was originally determined to be 'a side yard), cannot meet the setback
requirement of 25 feet. Staff feels in this case, that a rear yard variance of 14.3 feet should
be granted.
Staff does not feel that a 3 foot side yard variance is warranted. The applicant wishes a side

yard variance to accommodate for a second set of stairs to access the deck on top of the
garage. There clearly is no hardship in this request.
STAFF RECOMMENDATIONS: Staff recommends approval for a 14.3 foot rear yard

AGREEMENT
I (we), the undersigned, do hereby respectfully make
application, and petition the Frederick County Board of Zoning
Appeals (BZA) to grant a variance to the terms of the Frederick
County Zoning Ordinance as described herein. I agree to comply
with any conditions for the variance required by the BZA.
I authorize the members of the BZA and Frederick County
officials to go upon the property for site inspection purposes.
I understand that the sign issued to me when this application
is submitted must be placed atthe front property line at least
seven (7) days prior to the BZA public hearing and maintained so as
to be visible from the road or right-of-way until the hearing.
