THIS DEED, made and dated this day of ,
1973, by and between Charles P. Cabaniss and Patricia Cabaniss, his wife, par-
ties of the first part, hereinafter called the. Grantors, and
Milburn and Louise W. Milburn , his wife, parties of the second part,
hereinafter called the Grantees.
WITNESSETH: That the Grantors, for and in consideration of the
sum of Ten Dollars ($10.00) and other valuable considerations, paid to them
at and before the signing and sealing of this deed, the receipt whereof is
hereby acknowledged, do hereby grant, sell and convey, with General Warranty
of Title, unto the Grantees, as tenants by the entirety with common law right
of survivorship, all of the following described real estate:
All that certain lot or parcel.of land situate in Back Creek
District; Frederick County, Virginia, fronting on the Western side of Virginia
Secondary Road No: 608, and designated as Lot No., 6 on the plat of
Section .1, Cabaniss Subdivision, made by Charles H. Kirkland, C. L. S., re-
corded on July 13, 1972 , with the deed of dedication and declaration
of plat as Instrument No. 1976 , in the Clerk's Office of the Circuit Court
of Frederick County, Virginia.
The herein conveyance includes all improvements thereon and all
rights, rights of way, easements and appurtenances. thereunto appertaining.
The herein conveyance is subject to all reservations, restri--
ctions, covenants, conditions, rights, easements and rights of way, legally
enforceable, affecting said real estate, of record in said Clerk's Office,
including public utility easements, and the.express covenants set out in the
aforesaid deed of dedication which are by this reference made a part hereof
as if set.out in full.
The aforesaid Grantors covenant that they have a good right
to convey the said realty to said Grantees; that the said Grantees shall have
quiet possession of said land, that the same is free from all liens and en-
cumbrances except as hereinabove noted, that they have done no act to en-
cumber the same except as hereinabove noted, and that they will execute such
further assurances of title as may be requisite.
