THIS DEED, made this 1, day of Lr-e-" 19699 between
Frederick Development Co., Inc., a Virginia corporation, of the one part,
hereinafter called the Grantor , and Bruce E. Shuman and Rosemarie E.
Shuman, his wife, of the other part, hereinafter called the Grantees.
WITNESSETH: That for and in consideration of the sum of Ten Dollars
($10.00), cash in hand paid and other valuable consideration, receipt whereof
is hereby acknowledged, the Grantors do grant and convey, with General
Warranty of Title, unto the Grantees, as tenants by the entirety, in fee
simple, with survivorship as at common law, together with all rights,
privileges and appurtenances thereto belonging, all that certain lot of land
situated in Shawnee Magisterial District, Frederick County, Virginia, about
one (1) mile East of Winchester, designated as Lot 35, Section E on a plat and
survey of Frederick Heights Subdivision prepared in 1966 by Richard U. Goode,
C.L.S., nnc- recorded in the Clerk's Office of the Circuit Court of Frederick
County, Virginia, in Deed Book 320, at Page 168 and being a portion of the
property conveyed to the Grantor herein by deed from Philip B. Glaize, et al,
dated August 16, 1962 and recorded in the aforesaid Clerk's Office in Deed
Book 281, at Page 148,
This conveyance is made subject to all legally enforceable restrictive
covenants and easements of record affecting the aforesaid realty, including
those restrictive covenants of record in the aforesaid Clerk's Office in Deed
Book 320, at Page 168.
The Grantor covenants that it has the right to convey said realty to the
Grantees; that the Grantees shall have quiet possession thereof, free from all
encumbrances; that it has done no act to encumber said realty and that it will
execute such further assurances thereof as may be requisite.
