Code Rationale and Staff Recommendation. for Case No_ 008-79
June 11, 1979
Case No. 008-79 Richard Metz wishes to place a utility shed in an A-2 (agri-
cultural -general) District. In the A-2 section of the Zoning Ordinance, rear
yards must be of at least fifty (50) feet.
Since the applicant wishes to construct a shed that would be within fifteen
(15) of the rear property line, it would be necessary for a rear yard variance of
thirty-five (35) feet be obtained before a building permit could be. issued.
Staff Recommendation
Staff recommends approval. As the applicant has noted, to place the shed
fifty (50) feet from the rear would place it on his drainfield_ Section 21-
158(b) allows for variance for reason of topographic conditions or extraordina-
ry situation. The applicant can meet side yard requirements. Since I believe
there may.be opposition, I feel that placing the shed in the frontportion of
the property would be more detrimental to adjacent property (Sec.. 21-158(c) than
the proposed location.
As you have requested, I am reminding you and the applicant who receives a.
copy of this memorandum that staff recommendations are only the staff's .interpre-
tation of the Code and are in no way binding upon the Board of Zoning Appeals.

THIS DEED OF CORRECTION, made this 5th day of
August , 1975, between Arthur J. Webster and Virginia C.
Webster, his wife, of the first part, hereinafter called the
Grantors, and Richard E. Metz and Joan E. Metz, his wife, of the
second part, hereinafter called the Grantees, and Winston D.
Hensell and Nancy E. Hensell, his wife, of the third part,
hereinafter called Hensell. T
WHEREAS, by Deed dated February 8, 1972, and. recorded
in the Clerk's Office of the Circuit Court of Frederick County,
Virginia, in Deed Book 387, at Page 37, the Grantors did grant
to Hensell Lot No. 15 and the Western one-half of Lot No. 16,
Block B, on the plat of Lone Oak Subdivision, Section One,
recorded in said Clerk's Office in Deed Book 299, at Page 115.
WHEREAS, said subdivision of Lot No. 16 was not
approved; and, WHEREAS, a new resubdivision plat of Lot Nos. 15
and 16, Block B, on the plat of Lone Oak Subdivision, Section One,
and Lot No. 17, Block B, on the plat of Lone Oak Subdivision,
Section Two, has been made and approved and it is the desire of
all the parties hereto to correct said error.
NOW THEREFORE THIS DEED WITNESSETH: That for and in
consideration of the premises, the sum of Ten Dollars ($10.00),
cash in hand paid by each of the parties hereto to each of the
others, and other valuable consideration, receipt whereof is
hereby acknowledged, the Grantors do grant and convey with
General Warranty of Title unto the Grantees, as tenants by the
entirety, in fee simple, with survivorship as at common law,
together with all rights, privileges and appurtenances thereto

belonging, all that certain lot or parcel of land situate on the
South side of West Street, in Opequon Magisterial District,
Frederick County, Virginia, designated as Lot No. 15A on the plat
of the resubdivision of Lot Nos. 15 and 16, Block B, on the plat
of Lone Oak Subdivision, Section One, and Lot No. 17, Block B, on
the plat of Lone Oak Subdivision, Section Two, hereto attached
and made a part of this Deed as though set out herein in haec
verba.
Hensell joins in this Deed of Correction for the
purpose of conveying all his right, title and interest in and to
the described property to the Grantees, as tenants by the
entirety, in fee simple, with survivorship as at common law, and
to request the Grantors to make the above conveyance.
This conveyance is made subject to the legally
enforceable restrictive covenants, conditions, building lines and
rights of way of record, if any, affecting the aforesaid realty.
The Grantors covenant that they have the right to
convey said realty to the Grantees; that the Grantees shall have
quiet possession thereof, free from all encumbrances; that they
have done no act to encumber said realty and that they will
execute such further assurances thereof as may be requisite.
