Since the applicant wishes to complete an utility building that would be within ten (10) to twelve (12) feet from the right side property line, it- would be necessary for a side yard variance of from five (5) to eight (8). feet be•ob- tained before a building permit would be issued. Staff Recommendation.. Staff recommends approval. As you can see from the attached deed NLr_ Armel`s property sits at an angle from route 608. The partially completed hand made build- ing at this location cannot be seen from the road and as Mr. Armel has pointed out his garden would be affected by the move. While the foregoing are not adequate le- gal reason for granting variance other possible locations, according to k-rs_ Armel would interfere with their drainfield. The peculiar angle of the property (purchased in 1966) to the road and a gar- den that has been cultivated since before this board began to hear cases would suggest to me that Sec. 21-158(b) would apply in this case (Shape .of the. property and extraordinary situation of such piece of property): Also, it could be sug- gested that a property of this size and frontage would not be allowed under cur - .rent subdivision practices in an A-1 District. If this property were located in a zone in which it would currently conform a five (5) or (10) foot requirement for utility buildings would apply and it could conform.
