Lee Garber, Single, Juliar F. Garber and Margaret J. Garber, his wife, and Donald E. Case No. 002-79 Donald Garber wishes to erect an office building on his property which is located in a B-2 (Business -General) District. Under the parking regulations of the Zoning Ordinance (Section 21-13, i), any commercial building not listed shall provide one parking space for each one hundred (100) square feet of business floor space in the building. Since the applicant wishes to install one parking space for each two hundred (200) square feet of office space, it would be necessary for a variance from the commercial parking requirements to one parking space per two hundred (200) square feet of Business floor space be obtained before a site plan could be approved and a building permit obtained. Staff Recommendation Staff recommends disapproval. General Planning criteria seems to indicate thahparking requirements for office use are less than for other commercial uses and that one space per three hundred (300) square feet of office floor space would be more reasonable; however, Section 21-158, d would apply in this case since the off-street parking regulations do not distinguish office use and parking needs from other commercial parking requirements. The staff feels that the situation. of the property concerned is of such a general nature as to make reasonably practicable the formulation of a general regulation to be adopted as an amendment to this chapter. If the Board of Zoning Appeals concurs with the staff recommendation, it is suggested that the Board deny this petition and recommend to the Planning Commission that they consider modifying the minimum off-street parking regulations to allow less stringent requirements for general office uses than for general commercial uses. Hardship as defined in Section 21-158, b and c has not been shown since the property prior to this proposal (see deed book 499 page 185) would have had ample space to provide for the required parking.
