SUBJECT: Code Rationale and Staff Recommendation for Case No. 017-78.
Case No. 017-78.; Gore Fire Company wishes to erect a fire station on their
property which is located in a A-1 (Agricultural -Limited) District. In the
A-1 section of the Zoning Ordinance,. no building may be closer to the front
property line than sixty (60) feet.
Since the applicant wishes to erect a fire station that would be within
forty-two (42) to forty-five (45) of the front property line it would be
necessary for a front setback of from fifteen (15) to eighteen .(18) feet to
be obtained before a building permit could be issued.
Staff Recommendation:
Staff recommends approval since there is an extreme grade problem
that can be considered a topographic hardship as defined by the Zoning Ordinance.

wITNESSETH: That for and in consideration of the sum
of Ten Dollars ($10.00) and other good and valuable considera-
tion, the receiptlof all of which is hereby acknowledged, the
parties of the first part do hereby grant, bargain, sell and
convey with.general warranty of title, unto the party of the
second part, its successors and assigns, the following des-
cribed property and appurtenances thereunto belonging:
That certain tract of land situate in Gainesboro
Magisterial District, Frederick County, Virginia,
containing 6.774 acres and designated as Tract 2
on the plat prepared by Louis J. Matacia, C.L.S.,
dated August 10, 1974, which plat is attached hereto i
and by reference made a part of this deed. This
being -a portion of the same identical property con-
veyed to the parties of the first part by deed of
record in the Clerk's Office of the Circuit Court
of Frederick County, Virginia, in Deed Book 1Bq at
Page ^-I� .
Reference is here made to the aforesaid instruments
and the attachments and the references therein contained for a
further and more particular description of the property hereby
conveyed.
This conveyance is made subject to all duly recorded
and enforceable restrictions$ easements and rights of way.
The Grantors do hereby expressly reserve unto them-
selves, their heirs and assigns an easement and right of way ;
of ingress and egress forty feet (40') in width from the
remaining portion of its land, designated as Tract 1 on the i
attached plat, across the property herein conveyed to U. S.
Route 50. This easement shall be subject to relocation by the
Grantee herein or its successors and assigns so long as it
retains its character as a forty foot (40') right of way from the

Except as noted above, the grantors covenant that they
have a right to convey said property to the grantee; that thev
have done no other act to encumber said property; that they will
execute such further assurances of title to said property as may

said property free from all encumbrances.

THIS DEED, Made this loth day of June, 1977 by and between the
COMMONWEALTH OF VIRGINIA, acting by and through the State Highway and
Transportation Commissioner, Grantor, and GORE FIRE COMPANY, INC., Grantee;
WITNESSETH: THAT WHEREAS, the hereinafter described property was
acquired in conjunction with the State Highway System, and
WHEREAS, said property has been deemed no longer necessary for
this purpose, and
WHEREAS, accordingly this conveyance was authorized in accordance
with the provisions of S 33.1-149 of the 1950 Code of Virginia, as amended,
at a meeting of the State Highway and Transportation Commission held on
April 21, 1977 by a resolution duly adopted and recorded in the minutes of the

said meeting.
NOW, THEREFORE, for and in consideration of the sum of TWO HUNDRED
TWENTY-EIGHT DOLLARS ($228.00), receipt of which is hereby acknowledged, the
Grantor does hereby grant and convey, without warranty, unto the Grantee

the Back Creek Magisterial District of Frederick County, Virginia;
Being as shown on Sheet 5 of the plans for Route
50, State Highway Project 0050-034-104, RW-201
and being all the lands of the Commonwealth lying
northeast of and adjacent to the northeast revised
proposed right of way line (6-3-77) of Route 50
from the lands now or formerly belonging to the
Commonwealth at a point approximately 48 feet op-
posite approximate Station 196+20 (centerline pro-
posed W.B.L.) to the lands of the Commonwealth at
a point 48 feet opposite Station 198+30 (centerline
proposed W.B.L.) and containing 0.57 acre, more or
less, and being a portion of the lands as acquired
from Marshall W. Cooper by deed dated September 8,
1924 and recorded in Deed Book 153, Page 573, and
from Russell R. Cooper and Blanche Conrad Cooper by
deed dated August 30, 1966 and recorded in Deed Book
326, Page 133. Both of these deeds are of record in
the Office of the Clerk of the Circuit Court of
Frederick County.

veyance and is to be recorded simultaneously herewith

fire station on the property zoned Agricultural -Limited (A-1) and designated
as property identification number 27(A)88A, Route 50 West at Gore, in
Gainesboro Magisterial District.
The Public Hearing on the above variance will be heard by the Board of Zoning
Appeals of the County of Frederick, Virginia at 3:30 PM, November 8, 1978,
in the Board of Supervisors' Room, 9 Court Square, Winchester, Virginia.
Any interested parties having questions -or wishing to be heard may attend
this meeting.

We are in the process of building a new Fire Hall which w:i- l be
located just at the West edge of Gore along the North side of U* S.
Routs 50. We have already had Perry Enginwering do some site ueCMk
and Greenway Engineering is now preparing a Site Development Plat to
be considered by the Zoning Administrator and the other necessary
agencies.
One of the requirements we understand from spealdtng to Daretbza zi ,.,
St- efen is that the building be 60 feet from the Eight -of -Way line of A'
U. S. Route 50. In order to put the building back 60 feet. we vain$
reed either to fill the entire area and change the natural dralma&e : - 4:
to run water both ways from the building or insta.0 about 200 foot
of some type of drain to allow water to run through under the back
edge of the fill.
We would like to fill the entire area but that is out of our y FTP
financial reach at this time. We would also have liked to -hare made f;44
the present fill farther back but the Sanitarian said il' we did we M
would have to pipe the drainage through under the fill to prevent
any ponding of water which also is very expensive. »
What we are requesting is a variance allowing us to not our
building 40 feet from the Right -of -Way line of U. S. Route 50 which
Right -of --:Way is 0 feet from the center of the West Bound Lane.
This would allow us to use the present fill. We could possibly even
set the building back 45 feet and use the fill we now have. To set
the building back 60 feet would work a severe and we believe un-
necessary hardship on us.
