Holliday wishes to maintain a shed he erected on his property which is located in an A-2 (Agricultural -General) District. In the A-2 section of the Zoning Ordinance,accessory buildings must have a minimum side yard of fifteen (15) feet. Since the applicant wishes to'maintain a shed,that he erected without a building permit,that would be within two and a half (22) feet of the side property line, it would be necessary for a side yard variance of seventeen and a half (172) feet be obtained before'a building permit could be issued. If a variance is not granted,the shed will have to be removed. Staff Recommendation: Staff recommends disapproval. There is no hardship as defined by Section 21-158 of the Ordinance. Also, a building two and a half (212). feet from the property line is clearly not in harmony with the intended spirit and purpose of the Ordinance.(see Section 21-158,b). The shed does not meet rear yard require- ments by forty-six and a half (4612) feet but I can not determine whether the old shed, and therefore the new shed as an addition, qualifies as nonconforming since I can locate no building permit.
