Stefen, Zoning Administrator, SUBJECT: Code Rationale and Staff Recommendation for Case No. 006-78 to be heard June 20, 1978. Case No. 007-78 Harry F. Stimpson, III, owner and Bob and John D. Glover representing Gulf Oil Company, wish to erect a sign in a B-2 (Business -General) District. In the -Zoning= Ordinance,signs which are not attached to buildings are considered to be accessory structures. According to Section 21-113,d (Height Regulations), accessory structures in B-2 Districts must be less than the main structure in height, and as indicated by the applicant the proposed fifty-one (51) foot Gulf sign would be higher by twenty-five (25) feet than the twenty-six (26) foot high County Store. Since the applicant wants to erect a sign that will be higher..than the main structure, it would be necessary for a variance to be obtained before a sign permit could be issued. Staff Recommendation: Staff recommends disapproval. Other business signs in the immediate vicinity do not exceed approximately thirty-five (35) feet in height. Approval of a fifty-one (51) foot sign would set a precedent at this interstate interchange in a case where there is no "clearly demonstrable hardship approaching confiscation" and it appears that the applicant is seeking a "special privilege or convenience" and not a.,hardship as defined under Article XX, Section 21-158,b, of the Ordinance. According to the County Director of Inspections, the proposed sign as indicated in exhibit #1 is generally satisfactory.
