SUBJECT: Code Rationale for Case No. 020-77 to be heard October 18, 1977.
Case No. 020-77 The Church the applicant wishes to enlarge is in an A-2
Agricultural, General District. In A-2 Districts when a property fronts any
highway which -is fifty (50) feet or greater in width, the setback line is
sixty (60).feet from the highway right-of-way.
Since the applicant wishes to expand the Church to thirty (30) feet
from the highway right-of-way instead of sixty (60) feet it would be
necessary for him to obtain a variance before such expansion could occur.

THIS DEED OF CORRECTION, made and dated this day
of , 1966, by and between Herman J. Dyke and Dorothy
V. Dyke, his wife, hereinafter called the Grantors, and Trustees
of Winchester Pentecostal Holiness Church, hereinafter called the
Grantees.
WITNESSETH: That WHEREAS, by deed dated July 16,
1965, from Herman J. Dyke and Dorothy V. Dyke to Trustees of
Pentecostal Holiness Church of Clearbrook, Virginia, recorded in
the Clerk's Office of the Circuit Court of Frederick County,
Virginia, in Deed Book 31,3, at Page 49, the Grantors herein
attempted to convey a certain parcel of land containing 0.97
acre, situate on the East side of U. S. Highway No. 11 about four
and one-half (42).miles North of Winchester, in Stonewall Magis-
terial District, Frederick County, Virginia; and WHEREAS, the
description contained in said deed made no reference to the
precise or exact location of said parcel of land; and WHEREAS,
the name of the Pentecostal Holiness Church of Clearbrook,
Virginia, has been changed to Winchester Pentecostal Holiness
Church; and WHEREAS, it is the intention of the parties hereto ,
that an adequate description of the real estate intended to be
conveyed be evidenced by this deed of correction.
NOW, THEREFORE, in consideration of the premises and
the sum of One Dollar ($1.00), cash in hand paid the Grantors by
the Grantees, the receipt of which is hereby acknowledged, the
Grantors do hereby grant and convey, with general warranty of titl
unto the Grantees, their successors in such office and assigns

forever, in fee simple:
All of that certain lot or parcel of land, with
all rights, rights of way and appurtenances thereto
belonging, lying and being situate on the Southeast
side of U. S. Highway No. 11 four and one-half (41i)
miles North of Winchester, in Stonewall Magisterial
District, Frederick County, Virginia, and more particu-
larly described by a plat and survey of Lee A. Ebert,
Certified Land Surveyor, dated November 28 , 1966,
which is attached hereto and.made a part hereof by
reference. This is a portion of the same realty which
was conveyed to the Grantors by Anne L. Dickenson,
Widow, by deed dated December 30, 1958, and recorded in
the aforesaid Clerk's Office'in Deed Book 255, at Page
580.
This realty is conveyed in trust, nevertheless, for
use and benefit of the ministry and membership of the Winchester
Pentecostal Holiness Church with power to the Trustees thereof,
thair nuccensorn and annipns, to sell and convey, in fo-3 aimpla.
and to mortgage the whole or any part of the aforesaid realty to
any person or persons and for such sum or sums of money as the
said congregation of the Winchester Pentecostal Holiness Church
shall by majority vote at a meeting held for the purpose of
considering that question may appoint and direct; provided, that
before sale and conveyance the written consent to said sale shall
be obtained from the Mid -Atlantic Conference Board of the
Pentecostal Holiness Church,or its successor.
The Grantors covenant that they have the right to.
convey said realty to thhe Grantees; that said realty is free from
all encumbrances; that the Grantees shall enjoy quiet possession
of said property; and that the Grantors will execute such further
assurances of title as may be requisite.

All of that certain lot or parcel of land, with
all rights, rights of way and appurtenances thereto
belonging, lying and being situate on the Southeast
side of U. S. Highway No. 11 four and one-half (01)
miles North of Winchester, in Stonewall Magisterial
District, Frederick County, Virginia, and more particu-
larly described by a plat and survey of Lee A. Ebert,
Certified Land Surveyor, dated November 28 , 1966,
which is attached hereto and made a part hereof by
reference. This is a portion of the same realty which
was conveyed to the Grantors by Anne L. Dickenson,
Widow, by deed dated December 30, 1958, and recorded in
the aforesaid Clerk's Office in Deed Book 255, at Page
580.
This realty is conveyed in trust, nevertheless, for
use and benefit of the ministry and membership of the Winchester
Pentecostal Holiness Church with power to the Trustees thereof,
their successors and assigns, to sell and convey, in fee ;simple,
and to mortgage the whole or any part of the aforesaid realty to
any person or persons and for such sum or sums of money as the
said congregation of the Winchester Pentecostal Holiness Church
shall by majority vote at a meeting held for the purpose of
considering that question may appoint and direct; provided, that
before sale and conveyance

be obtained from the Mid -Atlantic Conference Board of the
Pentecostal Holiness Church,or its successor.
The Grantors covenant that they have the right to
convey said realty to the Grantees; that said realty is free from
all encumbrances; that the Grantees shall enjoy quiet possession
of said property; and that the Grantors will execute such further
assurances of title as may be requisite.

THIS DEED OF CORRECTION, made and dated this day
of L cr,, 1966, by and between Herman J. Dyke and Dorothy I
V. Dyke, his wife, hereinafter called the Grantors, and Trustees
of Winchester Pentecostal Holiness Church, hereinafter called the
Grantees.
WITNESSETH: That WHEREAS, by deed dated July 16,
1965, from Herman J. Dyke and Dorothy V. Dyke to Trustees of
Pentecostal Holiness Church of Clearbrook, Virginia, recorded in
the Clerk's Office of the Circuit Court of Frederick County,
Virginia, in Deed Book 31,3, at Page 49, the Grantors herein
attempted to convey a certain parcel of land containing 0.97
acre, situate on the East side of U. S. Highway No. 11 about four
and one-half (42) miles North of Winchester, in Stonewall Magis-
terial District, Frederick County, Virginia; and WHEREAS, the
description contained in said deed made no reference to the
precise or exact location of said parcel of land; and WHEREAS,
the name of the Pentecostal Holiness Church of Clearbrook,
Virginia, has been changed to Winchester Pentecostal Holiness
Church; and WHEREAS, it is the intention of the parties hereto
that an adequate description of the real estate intended to be
conveyed be evidenced by this deed of correction.
NOW, THEREFORE, in consideration of the premises and
the sum of One Dollar ($1.00), cash in hand paid the Grantors by
the Grantees, the receipt of which is hereby acknowledged, the
Grantors do hereby grant and convey, with general warranty of titl@
unto the Grantees, their successors in such office and assigns
