The petitioner— request —that the said Board doth grant:
A Rear Yard Variance of 24' to build a 14'X22' garage in back
of existing house.
The applicant —make —this request because:
Present Agricultural -Limited (A-1) zoning requires a minimum of
50 -for any structure to the rear property line. Proposed
garage would be 26 from property line. Therefore, 2 of
relief is. 'requested of the 50' Rear Yard requirement.
The person —and (his) (her) (their) address owning and/or occupying adjacent pro-
perty to the property sought to be affected (are) (is): (Give names of all owners adjacent,
across the road or highway and facing the property and any owners across any railroad right-

1975, by and between RICHARD J. BECK and MARTHA A. BECK, his wife
parties of the first part, hereinafter called the Grantors,
and DEZSO NE.M.ETH-BARATH, JR. 'and ANNA NEMETH-BARATH, his wife,
parties.of the second part, hereinafter called the Grantees,
and FARMERS AND MERCHANTS NATIONAL BANK of Winchester, Virginia,
party of the third part.
WITNESSETH: That for and in consideration of the
sum of Ten Dollars, ($10.00), cash in hand paid, and other good
.and valuable consideration, the receipt of which is hereby acknowl-
edged, the Grantors do hereby grant and convey with general warra ty
of title unto the Grantees, in fee simple, jointly, as tenants
by the entirety with right of survivorship as at common law,
it being intended that the part of the one first dying should
then belong to the other, his or her heirs or assigns, all of
that certain lot or parcel of land, together with the improvement
thereon and the appurtenances thereunto belonging, lying and
being situate in Gainesborc Magisterial District, Frederick County,
Virginia on the North side of U. S. Highway No. 522, and more
particularly described as Lot 8, Section One, Braddock Hills
Estates, as shown on that certain plat and survey dated January
10, 1969, drawn by H. Bruce Edens, C. L. S., of record in the
Office of the Clerk of the Circuit Court of Frederick County,
Virginia, in Deed Book 352, at Page 2371 wherein said lot is
shown as fronting 220.00 feet on the East side of Spring Valley
Drive and extending in an Easternly direction with a uniform
depth of 272.84 feet, and being the same property conveyed to
Richard J. Beck and Martha A. Beck, his wife, by deed dated
September 5, 1973, from Roland D. Bush, et ux, of record in the
aforesaid Clerk's Office in Deed Book 417, at Page 18. Reference
is made to the aforesaid plat and deed for a more particular
description of the property herein conveyed.

This conveyance is made and accepted subject to an
indebtedness secured by a deed of trust on said property dated
September'5, 1973, of record in the aforesaid Clerk's Office
in Deed Book 417, at Page 20, given to secure Farmers and Merchants
National Bank of Winchester, Virginia, the principal sum of !
$48,000.00, and on which there is an unpaid balance principal
of $20,000.00, with interest at the rate of 8 1/2% per annum,
which said deed of trust the Grantees hereby assume and agree
to pay as part of the purchase price of the above described
property, and the Grantees hereby execute and acknowledge this
instrument for the purpose of complying with the provisions
of the said deed of trust.
The party of the third part joins in the execution
of this deed 'solely for the purpose of consenting to the assumpti<
of the aforesaid deed of trust and the releasing of the Grantors
from personal liability under said note and deed of trust, but
does not in any way release the obligation or the deed of trust
dated September 5, 1973, of record in the aforesaid Clerk's
Office in Deed Book 417, at Page 20.
This conveyance is made subject to all easements,
rights of way and restrictions of record affecting said property.
Except as noted above, the Grantors covenant that
they have the right to convey to the Grantees; that the Grantees
shall have -quiet and peaceable possession of the said property,
free from all liens and encumbrances; and they will grant such
further assurances of title as may be requisite.
