WITNESSETH: That for and in consideration of the sum of

trict, Frederick County, Virginia, near Sunnyside,
and fronting on the Southeastern boundary line of
the 14 ft. right of way known as Carper's Drive,
and beginning at an iron pin in the said boundary
lines of Carper's Drive, a corner to the lot appear-
ing as No. 1 on that plat of survey of Lee A. Ebert
said lot containing 10, 532 square feet, running with
the Northeastern line of the said lot, South 58' 28 min.
2 sec. E-80.66 ft. to an iron pin in the Northwestern
line of the Sunnyside lot; thence with the said line N
32° 18 min. 20 sec. E-83 ft. to an iron pin in the
Southwestern line of the Chesshire lot; thence with the
said line N 58° 28 min. 2 sec. W - 80.66 it. to an
iron pin in the Southeastern boundary line of the
Carper's Drive right of way; thence with the said line
S 32° 18 min. 20 Sec. \V - 83 ft. to the beginning,
containing 6,693 square feet. This parcel is a por-
tion of that certain larger tract or parcel conveyed
to Russell T. Carper and Elva S. Carper, his wife,
by deed dated January 23, 1946, in Deed Book 194,
Page 551, in the Office of the Clerk of the Circuit
Court of Frederick County, Virginia. A plat of the
said lot being attached to and made a part of this
deed. A reference to the aforementioned deeds and
plats is here made for a further and more particular
description of the property herein conveyed.
This conveyance is made subject to all recorded conditions,
rights, rights of way, restrictions and easements affecting the property

The Grantor covenant -,'that she has the right to convey
the said lot to the Grantees; that she has -done no act to encumber the

VARIANCE POLICIES
For application to the Board of Zoning Appeals of the County of Frederick, Virginia,
as adopted April 16, 1976, and amended.
All Variance applications will contain:
1. One (1) copy of the application.
2. One (1) copy of a plot plan (1" = 20') suitable to the Zoning Code Administrator
showing:
a. Existing structures.
b. Measurements from existing structures to all property lines.
C. Measurements of any additions for which a Variance is requested.
d. Measurements of any additions for which a Variance is requested to all
property lines.
3. One (1) copy of Deed to the Land.
4. Every application for Variance shall be accompanied by a fee in the amount of
twenty dollars ($20) to cover the cost of advertising and other expenses
connected with the processing of the application.
5. At the time of application, the applicant shall post on the properties for
which the Variance is sought, a sign at least 36" X 48" with full information
on the Variance sought and the date, time and place of the hearing by the
Frederick County Board of Zoning Appeals. Such sign shall be placed at the
property line and be maintained so as to be legible.
6. The title of the representative for a Variance of an organization, church, etc.
shall be shown on the application.
7. The applicant or a representative applying for a Variance must be present at
the Board of Zoning Appeals Meeting for which his Variance is to be reviewed.
If the applicant or representative is not present, the Variance application
will then be tabled until the next Regular Meeting.
