JITNESSETH: That for and in consideration of the sum of Ten
!;Dollars ($10.00) cash in hand paid and other good and valuable considerations, re-
ceipt of all of which is hereby acknowledged before the sealing; and delivery of
this deed, the Grantors do hereby grant, bargain, sell and convey, with general
warranty of title, unto the said E. L. Peters and Ruth E. Peters, his wife, jointly
in fee simple, as tenants by the entirety, with the right of survivorship as at
common law, all of the following described property:
All of that certain tract or parcel of land _lying and being
'situate on the northern side of Virginia Secondary Highway No. 657, otherwise known'
as the Senseny Road, approximately one mile east of the City of Winchester,, VirginiA,
in Shawnee Magisterial District, Frederick County, Virginia, and more particularly
described in that certain plat and survey of Quentin R. Shortt, Certified Land

SUBDIVISION, FREDERICK COUNTY, VIRGINIA
1. Your Petitioner has entered into a contract for thel
sale of Lot 4, Block D of Senseny Heights Subdivision which sub-
division has been approved by the Board of Supervisors and is of
record in the Clerk's Office of the Circuit Court of Frederick
County, Virginia, in Deed Book 9,7 Page��.
2. That the purchaser desires to construct a dwelling
house thereon, which together with a two -car garage, will be
28 feet in depth and 83 feet long. That said building at its
Northern end where the garage is located will be 26.81, more or
less, from the rear property line, and the length of'the tri-
angular portion of the building within the restricted 35 foot
rear yard area is 24.5 feet. A diagram of the requested variance
is attached hereto.
3. Your petitioner therefore requests a variance of
the zoning ordinance affecting this matter to permit the proposed
building to occupy a triangular portion of the rear yard which
area of the yard so affected is estimated to contain about 134
square feet.
