THIS DEED made and dated this 22nd day of April, 1974, by and between
Wilkins Development Corporation, party of the first part, and Kenneth M. Burks
and Thelma Burks, his wife, parties of the second part.
WITNESSETH: That for and in consideration.of the sum of Ten Dollars
($10.00) cash in hand paid, and other good and valuable consideration,, the
receipt of all of which is hereby acknowledged, the said party of the first
part does hereby grant, sell, and convey, with general warranty of title, unto
the parties of the second part, as tenants by the entirety, with.common law
right of survivorship, a certain lot or parcel of land, together with all
rights, privileges, improvements and appurtenances thereto belonging, lying
and being situate along the Western side of Dogwood Road., about one wile East.
of Winchester, in Shawnee District, Frederick County, Virginia, fronting on
said Dogwood Road a distance of 72 feet, and extending back between parallel
lines a distance of 175 feet, and being the same land designated as Lot; No. 41
on the Plat of 1°Section 2, Wilkins' Shenandoah bills", subdivision, which is
of record in the Clerk's Office of the Circp it.Court of Frederick County,
Virginia, in Deed Book No. 285, pages 89 and 90, and further. being a portion.
of the land that was conveyed to the party of the first past by James R.
Wilkins, et ux, by deed dated January 8, 1963, and of record in the aforesaid
Clerk's Office in Deed Book No. 285, page 91.._ A reference to sai.d..records,
and to the references therein contained, is here made for further.and more
particular description of said land.
It is expressly stipulated that said lot is conveyed subject to all
applicable, or legally enforceable, restrictions, reservations and easements,
as set forth in the Deed of Dedication, or shown on the plat, of said sub-
division, which is of record in the aforesaid Clerk's Office in Deed Book No.
285, pages 86,87,88,89 and 90.
The aforesaid grantor covenants that it has the right to convey the
said land to the aforesaid grantees; that the said grantees - shall have quiet
possession of the said land, free from all encumbrances; that it has done no
act to encumber the said land; and that it will execute such further assurances
of the said land as may be requisite.
In testimony whereof the party of the first part has caused these
presents to be executed for it, and on its behalf, by James R. Wilkins, its
President, and its corporate seal to be duly affixed hereto, and attested by
