This letter is to confirm that the above -referenced variance application was approved by
the Board of Zoning Appeals at their meeting on May 17, 2016. The request on parcel
identified by Property Identification Number 6413-A-55 was approved by the BZA to
allow for a 40 foot left side yard variance to a required 50 foot left side yard setback will
result in a 10 foot left side yard setback and a 40 foot right side yard variance to a
required 50 foot right side yard setback will result in a 10 foot right side yard setback.
This property is located south side of Bufflick Road (Route 776), 0.32 miles east of
intersection with Front Royal Pike (Route 522) and is in the Shawnee Magisterial
District.

VARIANCE REQUESTED: The Applicant is requesting a 40 foot left side yard variance to a
required 50 foot left side setback resulting in a 10 foot left side setback, and a 40 foot right side yard
variance to a required 50 foot right side setback resulting in a 10 foot right side setback.
REASON FOR VARIANCE: The property is 0.5165 acres in size, and due to exceptional
narrowness of the parcel a structure cannot be built with the current RA (Rural Areas) Zoning
District setback requirements.

STAFF COMMENTS: This property was created in 1937 with the Lela M. Miller Subdivision and
the adjoining properties were created prior to 1937. Frederick County adopted zoning in 1967. The
Frederick County historical zoning map shows this property was zoned A-2 (Agricultural General) in
1967. The property setback lines at the adoption of the zoning ordinance were 35 feet for the front
and 15 feet for the side yards. Frederick County amended its ordinance in 1989 to change the A-2
Zoning District to the current RA (Rural Areas) Zoning District. The Frederick County Board of
Supervisors amended the setbacks for the RA Zoning District on February 28, 2007, making the
current setbacks for this property 60 feet to the front, 50 feet to the rear, 50 feet on the left side, and
50 feet on the right side.
This property does not have Building Restriction Lines (BRL) assigned to it, and would need to meet
the current RA (Rural Areas) setbacks. The Applicant is requesting a 40 foot variance on the left
side and the right side, from the required 50 foot side setback resulting in a 10 foot left side and right
side yard setback. Should this variance be granted, the building setbacks for this property would be
60 feet in the front, and 10 feet left and right side.
STAFF CONCLUSIONS FOR THE MAY 17, 2016 MEETING: The Code of Virginia 15.2-
2309 (2) and Code of Frederick 165-1001.2, states that no variance shall be granted unless the
application can meet the following requirements:
1) The property interest for which the variance is being requested was acquired in good
faith.
2) The granting of the variance will not be a substantial detriment to adjoining property
or nearby properties in the proximity of that geographical area.
3) The condition or situation of the property concerned is not of so general or recurring
as to make reasonably practicable the formulation of a general regulation to be
adopted as an amendment to the ordinance.
4) The granting of the variance does not result in a use that is otherwise permitted on
such property or a change in the zoning classification of the property.
5) The relief or remedy sought by the variance is not available through a special
exception or the process for modification of a zoning ordinance.
These proposed setbacks of 60 feet front, 10 feet left and right side, and 50 feet rear would be
consistent with the character of the district; and meets the intent of The Code of Virginia 15.2309 (2)
and the Code of Frederick County. This request from current setbacks of the RA (Rural Areas)
Zoning District may be justified.

This parcel is Lot 5 of Block 1 of the Lela M. Miller lots recorded in DB 174 Pg 394 around about 1937. All of the lots were 75' wide on Bufflick Road by
300 feet deep. Zoning was not applicable at the time and many of the lots have buildings that are even less non -conforming that this proposal.
Today's zoning ordinance requires minimum 50 foot side yard setbacks which would render this lot completely unbuildable.

C. PANGLE, party of the first part, hereinafter called the Grantor, and GEORGE M.
MURPHY, party of the second part, hereinafter called the Grantee.
WITNESSETH: That for and in consideration of the sum of Ten ($10.00)
Dollars, cash in hand paid, and other good and valuable consideration, the receipt of
which is hereby acknowledged, the Grantor does hereby grant and convey with general

the following described tract or parcel of land:
All of that certain tract or parcel of land, lying and being situate in
Shawnee Magisterial District, Frederick County, Virginia and being
designated and described as Lot 5, Block 1, on the plat of Lela M.
Miller Lots of record in the Clerk's Office of the Circuit Court of
Frederick County, Virginia, in Deed Book 174 at Page 394; said lot
fronts 75 feet, more or less, on the south side of Buffalo Lick Road
(now known as Bufflick Road) and extends back in a southerly
direction a distance of 300 feet, more or less; AND BEING the same
land conveyed to Luther Pangle by Deed dated September 2, 1941
from Lela M. Miller of record in the Clerk's Office of the Circuit
Court of Frederick County, Virginia, in Deed Book 183 at Page 371.
Luther Pangle died intestate in York, Pennsylvania, on June 1, 1959,
survived by his widow, Ethel Virginia Pangle, and John C. Pangle, his
only son, as his sole heirs at law; Ethel Virginia Pangle died on May
20, 1999 in the Town of Luray, Page County, Virginia, survived by
John C. Pangle as her sole heir at law. The title is, therefore, vested in
John C. Pangle under the laws of intestacy in the Commonwealth of
Virginia.
This conveyance is made subject to all easements, rights of way and restrictions
of record affecting the subject property.
