STAFF COMMENTS: This application is a variance to allow for a three (3) foot encroachment
into the rear setback for a deck. The property is zoned RP (Residential Performance) and has a
square footage of 12,468 sq. ft., with a single-family dwelling built on the property. The Frederick
County Zoning Ordinance allows for lots in the RP Zoning District to range in size from 100,000 sq.
ft. to 3,000 sq. ft. Section 165-65 C of the Frederick County Zoning Ordinance, requires setbacks to
be: 35 feet front, 10 feet sides, and 25 feet rear.
The setbacks for unroofed decks in the RP Zoning District are 15 feet. The Applicant applied for a
building permit (#638-2016) with rear setbacks of 15 ft. Section 165-23 H of the Frederick County
Zoning Ordinance requires survey standards to establish the location of primary structures located
five (5) feet or less from the minimum setback requirement of the zoning district in which the
property is located. This building permit was required to provide setback surveys. The Applicant
caught the setback violation during construction layout prior to the setback survey.
STAFF CONCLUSIONS FOR THE JUNE 21, 2016 MEETING: The Code of Virginia 15.2-
2309 (2) and Code of Frederick 165-1001.2, states that no variance shall be granted unless the
application can meet the following requirements:
1) The property interest for which the variance is being requested was acquired in good
faith.
2) The granting of the variance will not be a substantial detriment to adjoining property
or nearby properties in the proximity of that geographical area.
3) The condition or situation of the property concerned is not of so general or recurring
as to make reasonably practicable the formulation of a general regulation to be
adopted as an amendment to the ordinance.
4) The granting of the variance does not result in a use that is otherwise permitted on
such property or a change in the zoning classification of the property.
5) The relief or remedy sought by the variance is not available through a special
exception or the process for modification of a zoning ordinance.
Careful consideration should be used in regards to this variance. This violation to the setback
requirements of the RP Zoning District for an unroofed deck is self-inflicted, and should not be
granted.

Dear members of the Board of Zoning Appeals,
We began the process of building a deck for the Richs and looked at manifold options for deck
dimensions and stair location. The Home Owners Association restricted us from placing the
stairs on the right side of the deck and the Richs due to the possibility of being observed from the
road and for practical and specific reasons, the homeowners wanted the steps on the back of the
deck. We began to put the steps on the right side of the deck as seen by the filled -in footers. We
realized shortly after that this was past the setback so we moved the stairs to the left side of the
deck. The current location was our only option. It was not preferable but was acceptable to the
homeowner. When we started, we thought we were just within the setback range. We made a
mistake. (Note: On the plat, the setback limit is 25ft. Planning and Zoning informed us it is
actually 15 feet.) In addition, we presumptuously began building the deck thinking we were OK
and for this, we sincerely apologize.
After making this mistake, we have reorganized the internal processes of our company to tighten
restrictions and are putting in place a set of Standard Operating Procedures (SOP's) which will
dictate a mandated process for the flow of a project such as this deck so this situation will never
happen again. We have already implemented these procedures on the next large project we are
planning for a customer. Blueprints have been drawn and next, at the time of this application
submission, we will soon submit the permit paperwork to Frederick County Inspections
Department and to the Home Owners Association. Prior to removing one shovel -full of dirt, we
will have all the appropriate documentation and approvals in place. We respectfully ask the
Board for leniency in this matter and a one-time grant of a three foot variance. As we previously
mentioned, HOA and homeowner restrictions dictated the current step placement. In addition,
the lot directly behind the property in question is HOA-owned common area dedicated to a storm
water management facility (see attached deed for the Old Dominion Greens Phase I Common
Area #140000576) so a three foot variance will have minimal impact upon the adjacent property.
(In addition, see the deed indicated by #060022304 for a pictorial representation of the Common
Area.)
Recently, our business has endured many hardships due to serious medical complications of
management, weather -related time off, and project -related setbacks. Having to make significant
alterations to the deck will produce a serious impact on the viability of our business. It will also
impact the plans and desires of the homeowners. Thank you for your consideration. We fully
understand we are not owed anything by the Board and we sincerely apologize to you. We have
taken steps to ensure an incident like this will never happen again. We ask you to please
consider our request in this variance application.

THIS DEED OF DEDICATION, made and dated this Aday of November, 2006,
by and between JASBO, INC., a Virginia Corporation, party of the first part, hereinafter
called 'Declarant"; and THE COUNTY OF FREDERICK, VIRGINIA, party of the
second part.
RECITALS
A. The Declarant is the owner in fee simple of that certain tract of land containing
27.1899 acres, more or less, lying and being situate in Opequon Magisterial District,
Frederick County, Virginia (the "Property"), as more particularly described on that certain
plat titled "Final Subdivision Plat Old Dominion Greens Phase I" drawn by Jason G. Bly,
L.S., dated August 4, 2006 (the "Subdivision Plat"), a copy of which is attached hereto and
incorporated herein by reference as if set out in full.
B. The Property is a portion of the real estate previously conveyed to the Declarant by
that certain Deed dated March 18, 1976, of record in the Office of the Clerk of the Circuit
Court of Frederick County, Virginia (the "Clerk's Office"), in Deed Book 456, at Page 32.

C. The Property has been subdivided into Lots 1 through 68, inclusive, of Old
Dominion Greens, Phase I, Outlot "A" and certain streets, as set forth on the attached
Subdivision Plat. The attached Subdivision Plat accurately shows the metes and bounds of
the subdivided lands, together with the dimensions of each Lot thereof.
D. The Subdivision Plat also sets forth the location of building restriction lines,
drainage easements, gas pipe line easements, sanitary sewer easements, waterline easements,
ingress/egress easement, storm sewer easements, Shenandoah Gas Co. easements, a
temporary grading easement, temporary turnaround easement, and other matters, as more
fully set forth on the Subdivision Plat.
E. The Declarant now desires to subdivide the Property into lots to be known as Old
Dominion Greens, Phase I. The subdivision of the Property, as it appears on the attached
Subdivision Plat, is with the free consent and in accordance with the desires of the

Subdivision') for purposes of the installation, construction, re -construction, maintenance,
repair and/or removal of a pedestrian and bicycle trail and landscaping in connection with and
as part of a residential development to be located upon the aforementioned adjacent Future
Residential Subdivision, or any portion thereof, together with rights of ingress/egress over
and upon the Trail/Landscaping Easement by residents, family members, guests and/or other
invitees of residents of the aforesaid Future Residential Subdivision. The Trail/Landscaping
Easement created hereby shall be a permanent, perpetual and appurtenant right of way or
easement running with the title to the Common Area for the benefit of the Future Residential
Subdivision.
Section 3. Additional Easements: Designated upon the Subdivision Plat are the
location of building restriction lines, drainage easements, gas pipeline easements, sanitary
sewer easements, waterline easements, a temporary grading easement and other matters as
more fully set forth on the attached Subdivision Plat, which easements and other matters as
set forth thereon are hereby impressed upon and shall run with the title to the Lots and
Common Area, as applicable.
Section 4. Reservations.
(a) The Declarant reserves unto itself, its successors and/or assigns, the right to
erect, maintain, operate and replace underground telephone and electrical conduits, related
equipment, and other facilities, sewer, gas, water and television lines and related equipment,
and other utility equipment (which may be installed above ground) where such utility lines
and equipment are located within the utility easements set forth on the Subdivision Plat.
(b) The Declarant further reserves unto itself, its successors and/or assigns, for a
period of five (5) years from the date of conveyance of the first Lot in Old Dominion Greens
Phase I, a blanket easement and right on, over and under the ground within the Subdivision
(including, but not limited to, the Lots and the Common Area) to maintain and correct
