REASON FOR VARIANCE - The topographic conditions are such that if a house is built

BACKGROUND INFORMATION - A 60' front yard setback is required in the A-1 Zoning
District from the road right-of-way. The applicant wishes to construct a house
45' from the right-of-way. A 15' variance is required.

1. Said lots shall be used for residential purposes
only, and not more than one (1) single-family dwelling house
shall be erected thereon.
2. Said lots skull not at any time be subdivided,
conveyed or sold except as a whole unless such subdivision,
conveyance or sale involves multiple lots so that each of the
portions into which the lots are divided for the purpose of
subdivision, conveyance or sale results in the lots being created
for the purpose of such subdivision, conveyance or sale, as well
remaining after such subdivision, conveyance
as each of the lots
or sale, being of a size larger than the lots as shown on said
plat and survey.
3. No residential dwelling containing less than one
thousand two hundred (1,200) square feet, excluding garages,
carports, porches, verandas and decks, shall be erected on any
lot.
• 4. No trailers, campers or mobile homes shall be
erected or maintained on any lot at any time.
5. Each lot shall be impressed with a Seventy -Five

maintenance. The property owners association may, by appropriate
majority action, amend the amount of the annual roadway maintenance
fee to insure reasonable and proper roadway Maintenance. The
acceptance by any lot owner of a deed to any lot in such subdivi-
sion and the recordation of :such deed in the Clerk's Office of I
the Circuit Court of Frederick County, Virginia, shall constitutes
the lot owner's acceptance and agreement to be bound by the
provisions herein. `
Lot'No's. 1-17, inclusive, shall be subject to a 20-ft.
wide drainage easement reserved by the Owner on the inside of all
exterior boundary lines and a 10-ft. wide drainage easement on
eaoh side of all interior lot division lines, all of which is set
forth on Sheet 1 of the attached plat and survey hereinabove
mentioned.
