PROPOSED USE & IMPROVEMENTS - Single Family Home
VARIANCE - 10' front yard (setback) variance
REASON FOR VARIANCE - Steep drop off 125' from center of right-of-way.
Back of house would be on down slope of drop off.
The drop off is 75' to 80' high. Proposing to build
a Foremost Home which is 48' x 35' 4" with a walk -out
basement. Erecting the house 90' from center of right
away would place back of home on the steep drop off.
BACKGROUND INFORMATION - The applicant is seeking a 10' front yard (setback)
variance of the A-1 zoning regulations. A 60'
distance is required from the edge of the road
right-of-way. The applicants house is proposed to
be 50' from the right-of-way.
STAFF COMMENT - The staff has reviewed the applicants building permit.
Before the permit is issued the setback requirements need
to be met.

THIS DEED, made this �day of 1985,

by and between Draco, Inc., an Indiana corporation authorized to
do business iii the State of Virginia, hereinafter called the
Grantor, and Judy S. Dunlap, feme sole, hereinafter called the
Grantee.
WITNESSETH: That in consideration of the sum of Ten
Dollars, ($10.00), and other valuable considerations paid the
Grantor by the Grantee on or before the delivery of this Deed,
the receipt of all of which is hereby acknowledged, the Grantor
hereby grants, sells and conveys, with general warranty and with
English covenants of title, unto the Grantee, in fee simple, as
feme sole, as her sole and separate equitable estate, pursuant
to Section 64.1-21 of the Code of Virginia, 1950, as amended, the
following real estate, together with all improvements and
appurtenances thereto belonging but subject to all easements
and legally enforceable restrictions and reservations of record
affecting such realty:
All of that certain parcel of land containing
7.559 acres, more or less, located about seven miles
West of Winchester, in Gainesboro Magisterial District,
Frederick County, Virginia, designated as Lot No. 13,
Devland Farms Subdivision, as shown on a plat which
is attached to an Instrument of Dedication by Draco,
Inc., dated April 14, 1978, and recorded in the Clerk':
office of the Circuit Court of Frederick County,
Virginia, in Deed Book 490, at Page 127, together
with and subject to a 60 foot wide right of way shown
on said plat, to be used in common with the Grantor,
its successors and assigns, for ingress and egress to
and from U. S. Hiqhway No. 50. This is a portion of
the same realty which was conveyed to the Grantor by
Howard O. Meuche, et al, Partners, t/a Devland
Associates, by Deed of Assumption dated February 5,
1976, and recorded in said Clerk's Office in Deed
Book 455, at Page 240.
`Phis conveyance is expressly made subject to the
restrictive covenants running with the land and easements as
iI set forth in said Instrument of Dedication.
