REASON FOR VARIANCE - The applicant states that the variance is
needed to make the new addition the same distance from the property
line as the existing garage. The applicant states that this is the
only place to put the addition because of the way the house is
designed, the corner lot location, and the existing drive.
BACKGROUND INFORMATION - The applicant is seeking an 11'3" side, yard
variance for an attached two -car garage. The A-1 (Agricultural
Limited) Zoning District requires a 15' side yard. This structure is
considered part of the house and is located 3'9" from the side
property line, therefore, a variance is required.
STAFF COMMENT - Prior to construction, an approved building permit is
required.

parties of the first part, and Nathaniel H. DeHaven and Mary Virginia DeHavens,
his wife, parties of the second part.
WITNESSETH: That for and in consideration of the sum of One Dollar
($1.00) cash in hand paid, and other consideration deemed valuable at laws
the receipt of all of which is hereby acknowledged, the said parties of the
first part do hereby grant, sell, and convey, with general warranty of title,
unto the parties of the second part jointly, with common law right of survivor-
ship, all of that certain lot or parcel of land, together with all improve-
ments and appurtenances thereto belonging, lying and being situate on the
Southwestern side of Virginia U. S. Highway No. 522, at the intersection of
Virginia State Secondary Highway No. 600, at Gainesboro, in Gainesboro
District, Frederick County, Virginia, fronting on said Highway No. 522 a
distance of 103 feet, more or less, and extending back Southwestward a uniform
width along the Northwestern side of said Secondary Highway No. 600 a distance
of 232 feet, more or less, and being the same land that was conveyed to the
parties of the first part by Elizabeth J. Darlington et vir, by deed dated
September 20, 1940s of record in the Clerk's Office of the Circuit Court of
Frederick County, Virginia, in Deed Book No. 182, page 52. A reference to
said record, and to the references therein contained, is here made for a
further and more particular description of said land.
