variance for an accessory structure. This property is zoned A-1,
Agricultural, Limited and designated as Tax Map 42(A), Parcel 309 in
the Gainesboro Magisterial District.
BACKGROUND INFORMATION
The applicant has begun construction of an accessory building 10
feet from the property line. He wishes to complete construction and is
seeking a variance from the yard requirements. Those requirements call
for a minimum of 15 feet for accessory buildings.

his wife, parties of the first part; and Preston Parker Perkins,
Jr., party of the second part.
WITNESSETH: That for and in consideration of the sum
of Ten ($10.00) Dollars, and other good and valuable cons4.,'eratio}
the receipt of which is hereby acknowledged, the said parties of
the first part do hereby convey, with general warranty of title,
unto the said party of the second part, in fee simple, all of tha
certain tract of land, lying and being situate on the East side I
of U. S. Route 522 in Frederick County, Virginia, more particular)
described as fronting on the West side of U. S. Route 522 for
a distance of 305 feet, more or less, and extending back with
an irregular width for a distance of 106 feet along its
northern boundary, more or less; and 216 feet along its Eastern
boundary contiguous to a lane for a distance of 106 feet, mere j

dated June 27, 1939, of record in the Clerk's Office of the

Page 389; and the remainder of the land conveyed to Carl C.
Whittaker by deed of Lillie M. Bamberger, et vir, dated
September 28, 1943, of record in the aforesaid Clerk's Office
in Deed Book 187, Page 556, and being all of the remainder of
the property conveyed to Carl C. Whittaker, et ux, by deed of i
Ernest Bamberger, et al, dated August 25, 1949, of record in the
aforesaid Clerk's Office in Deed Book. 211, Page 124, excluding
