feet of garage space; also, there are two or three steps coming out
from the house which take up approximately 2 1/2 feet and this will
make it difficult to open the doors of the automobile.
BACKGROUND INFORMATION - This application is for a reduction of the
required side yard of 10 feet in the RP (Residential Performance)
Zoning District. The applicant wishes to construct a 16 foot wide
attached garage to his house.
STAFF COMMENT - A building permit is required prior to any
construction.

his wife, of the one part, hereinafter called the Grantors, and

WITNESSETH: That for and in consideration of the sum
of Ten ($10.00) Dollars, and other valuable consideration, the

grant and convey with general warranty and English covenants of
title, unto the Grantees, in fee simple, as tenants -by the

and being the same realty conveyed to the Grantors by deed of
Apple Towne, Inc.,.a Virginia Corporation, dated January 15,
1975, of record in the aforesaid Clerk's Office in Deed Book
453, Page 750, to which deed and the references therein,
reference is here made for a more particular descrj•ption of the
property herein conveyed.
This conveyance is made subject to duly recorded and
enforceable restrictions as shown on that certain Deed of
Dedication dated December 12, 1973, except for restriction (a)
which provides:
No dwelling house shall be constructed on
any lot at a cost less than $18,000.00 exclusive
of lot cost, nor having a foundation area of less
than 1,000 square fee, or 1,250 square feet if
including carport or garage, or 18,000 square feet
for a 2-story or split level home developing both
