APPEAL REQUESTED - A 37 foot front yard setback variance for a
warehouse structure.
REASON FOR VARIANCE - The shallow depth of the lot does not permit
construction of a suitable depth of building. A power company
easement along the rear property line will not permit the building to
be positioned to the rear of the lot.
BACKGROUND INFORMATION:
This application is for a reduction of the required setback (front
yard) of 75' for structures located in the M-1 (Light Industrial)
Zone. The applicant proposes to construct a warehouse 38' from the
property line, therefore, requiring a 37' variance.
STAFF COMMENT:
This property narrows from 200' at the southern property line to 170'
at the northern property line because of the Highway Department
right-of-way along the bank of Lenoir Drive. This embankment has now
been removed due to excavation on the site. At the widest portion of
this lot, which is along the southern end of the lot, the building is
60' from the Highway Department right-of-way. The staff has received
a site plan to be submitted to the Planning Commission for approval.
This site plan is pending until the Board of Zoning Appeals action.

All work has been completed on the James T. Wilson project located on
the south-east end of Lenoir Drive, therefore, the bond being held to
insure performance of this site is no longer necessary.
The letter of credit from the Farmers and Merchants National Bank has
already expired and no action is required by your office.
