BACKGROUND INFORMATION The applicant wishes to subdivide the property into four housing lots (see plat). Primarily due to the required right-of-way width for the proposed road, the applicant feels that he could not economically finance the roadconstruction and maintain the required lot areas and lot widths. The lot area requirement is 12,000 square feet. The lot width requirement is 80 feet and 100 feet on corner lots. Horne, Dir.ector,�T " SUBJECT: Action by Board of Zoning Appeals"on Variance Request by David Holliday DATE: September 3, 1981 The Frederick County Planning Commission, at their meeting of September 2nd, received a letter from David Holliday stating that he has no intention of submitting the subdivision plat on the property which he received a recent variance from the Board of Zoning ® Appeals. While the Commission felt that this attitude by Mr. Holliday was very beneficial, it also felt that it did not directly address the action by the Board of Zoning Appeals. They felt that the action taken by the Board of Zoning Appeals did remain in effect and Mr. Holliday could legally decide to subdivide the property in accordance with that variance. Upon submission of a correctly drawn plat of the property, the Commission felt it would be very difficult to deny the subdivision. After considering the above issues, the Planning Commission felt that the Board should continue the -legal action against the Board of Zoning Appeals. The Commission felt that in the absence of this action, the variance would remain in effect and would continue to present a problem in the administration of the zoning ordinance and subdivision ordinance. The staff is currently working with Mr. Ambrogi to develop a series of recommendations on possible legal remedies. HORNE WINCHESTER, VIRGINIA 22601 DEPUTY DIRECTOR M E M O R A N D U M TO: Frederick County Board of Zoning Appeals FROM: Frederick County Planning Commission SUBJECT: Variance Application of David Holliday DATE: August 18, 1981 The Planning Commission for Frederick County, meeting in regular. session on August 5, 1981, requested that the Director of Planning appear before the Board of Zoning Appeals to share some concerns regarding the merits of the David Holliday variance request. The concerns raised are as follows: 1. Possible precedent setting issues on lot size reduction. There are a number of existing right-of-way situations similar to this case throughout the County. If lot size reduction is allowed, it could have serious implications in other existing subdivisions in the County. 2. The Comprehensive Plan is in the process of being updated. There are a number of options being considered which would allow this type of proposal without seeking a variance. It is realized that the time frame would be longer but the results could remedy this particular situation. In conclusion,, the Planning Commission would like to thank the Board of Zoning Appeals for allowing input on this case.
