Griffin, II, Esquire, pursuant to Section 15.2-2314 of the Virginia Code, and petitions this Court to issue a Writ of Certiorari to review a decision by the Respondent, Board of Zoning Appeals ("BZA") of Frederick County, Virginia. In support thereof, the Petitioners state the following: 1. By letter from the Frederick County Department of Planning and Development dated April 27, 2005, Petitioners, Jeffrey and Peggy Howell, were notified they were in violation of Section 165 -76 of the Frederick County Zoning Ordinance. Specifically, Petitioners were found in violation of housing agricultural animals (horses) on the property located at 128 Deep Pine Court, Gore, Virginia of the Timber Ridge Farms Subdivision. 2. By letter dated May 27, 2005, Petitioners, Jeffrey and Peggy Howell, requested from Respondent, Mark R. Cheran, Zoning Administrator for Frederick County, a zoning determination related to the Timber Ridge Farms Subdivision, wherein they requested an interpretation of Section 165 -76 of the Frederick County Zoning Ordinance, for "permitted uses" in the Residential Recreational Community (R5) District. The subject property is located at 128 Deep Pine Court, tax identification number 17 4 44, in the Gainesboro Magisterial District. 3. After a public hearing before the Board of Zoning Appeals on July 19, 2005, Mr. and Mrs. Howell's appeal was denied by letter dated Judy 20, 2005, and signed by Mark R. Cheran, Zoning Administrator. 4. Respondent, Frederick County, is the local government entity in Frederick County, Virginia that is charged under the provisions of the Constitution and statutes of the Commonwealth of Virginia including Chapter 22 of Title 15.2 of the Code of Virginia and the Zoning Ordinance of Frederick County with the regulation of land development, land use, and the promulgation of the local ordinance and their interpretation. 5. Pursuant to Section 15.2 -2311 of the Code of Virginia, by letter and application dated May 27, 2005, Petitioners appealed the determination of the Zoning Administrator to the Board of Zoning Appeals of Frederick County, Virginia, contenting that the correct interpretation of Section 165 -76 for permitted uses allowed horses to be kept on the Timber Ridge Farms Subdivision property. 6. The Respondent, BZA is a creature of statute and is authorized to hear and decide appeals from any order, requirement, decision, or determination made by the Zoning Administrator. 7. The BZA's affirmed the decision of the Zoning Administrator following a Public Hearing on July 19, 2005. 8. The BZA's final decision in Case No. 17 -05 was accordingly made on July 19, 2005 and became final upon the filing of that decision in the office of the BZA riot earlier than that day. Accordingly, this Petition is timely filed within thirty (30) days of the filing of that decision in the office of the BZA as provided in Virginia Code Section 15.2 -2314. 9. Petitioners are aggrieved by and hereby appeal the BZA's decision in the aforementioned Case No. 17 -05: 10. The BZA's decision interpreted Section 165 -76 of the Frederick County Code in a manner that is erroneous and plainly wrong. 11. According to the Timber Ridge Farms Homeowner's Association Rules and Regulations, as accepted by Frederick County in 1978, specifically i G, allowing "fowl, horses, ponies, and not more than two heads of cattle," on the Timber Ridge Farms Subdivision property, Petitioners are not in violation of any Frederick County laws or ordinances. 12. The BZA's decision in case No. 17 -05: (1.) is plainly wrong, (2.) applied erroneous principles of law and statutory construction; and (3.) is a violation of the purpose and intent of the ordinance. WHEREFORE, Petitioners are aggrieved by the decision of the BZA in Case. No. 17 -05 and respectfully request the following: A. That the Court issue a Writ of Certiorari in the form attached hereto and that the same be served upon the BZA requiring that a verified return be made within thirty (30) days of originals or certified copies of all exhibits, transcripts of the hearing, and other papers considered by the Respondent, BZA, in making its decisions in Case No. 17 -05, and that such return shall concisely relate such facts that may be pertinent and material to show the grounds of the decision appealed from. B. That the Court schedule a hearing on this matter and take such testimony and receive such evidence necessary for the proper disposition of this Petition. C.
