THIS DEED, made and dated this 28 day of April, 2006, by and
between ROBERT R. KENNEDY, party of the first part, hereinafter called the
Grantor; and Z L. METZ CONTRACTING, L.L.C., a Virginia Limited Liability
Company, party of the second part, hereinafter called the Grantee.
WITNESSETH: That for and in consideration of the sum of Ten Dollars
($10.00), cash in hand paid and other good and valuable consideration, receipt
whereof is hereby acknowledged, the Grantor does grant and convey, with General
Warranty and with English Covenants of Title, unto the Grantee, in fee simple,
together with all rights, rights of way, any improvements thereon and the
appurtenances thereunto belonging, all of the following realty:
All of that certain tract or parcel of land lying and being situate along
the southwestern side of Virginia State Secondary Highway No. 644,
commonly known as the Parkins Mill Road, about six miles southeast
of Winchester, in Shawnee Magisterial District, Frederick County,
Virginia, more particularly described as Parcel B", containing 1.351
acres, more or less, as shown on plat and survey prepared by
Quentin R. Shortt, C.L.S., dated March, 1966, recorded in the Office
of the Clerk of the Circuit Court of Frederick County, Virginia, in
Deed Book 331, at Page 685, and in Deed Book 678,, at Page 775,
and by this reference made a part hereof as if set out in tull; AND
BEING the same property conveyed to Robert R. Kennedy by Deed
from James A. Phillips and Vivian J. Phillips, husband and wife,
dated March 21, 2005, recorded in the aforesaid Clerk's Office as
Instrument No. 050005800.

Reference is here made to the aforesaid instruments, the attachments
