VA 22601 RE: Fax Map Number 29 -A -60, 107 Gainesboro Road Dear Ms. Roberts: This letter is to inform you that a stop work order has been posted for the above mentioned property until the zoning violation has been resolved. Section 114.1 Issuance of order. When the building official finds that work on any building or structure is being executed contrary to the provisions of this code or any pertinent laws or ordinances, or in a manner endangering the general public, a written stop work order may be issued. The order shall identify the nature of the work to be stopped and be given either to the owner of the property involved, to the owner's agent or to the person performing the work. Following the issuance of such an order, the affected work shall cease immediately. The order shall state the conditions under which such work may be resumed. This denial was for a 20 foot rear yard variance, which would have resulted in a 30 foot rear yard setback line. During the meeting, you modified your request from a 20 foot rear yard variance to a 3.6 foot rear yard variance. The subject property is located at 107 Gainesboro Road (Route 684), and is identified by Property Identification Number 29 -A -60 in the Stonewall Magisterial District. The decision of the Board of Zoning Appeals may be appealed to the Circuit Court of Frederick County within 30 days of the Board's decision.
