Review Comments 1) jppryval Block Provide the expiration language for the approval block. Expiration language has been added to the approval block. 2) Parking Setbacks. Prot-rde the parking lot setbacks on the cnvenbeet. Parking setbacks have been added to the plan. 3) P kig Calculations. The parking calculations shown on the coverrheet are incorrect. New parking requirements for this use were recently adopted (1.5 spaces per employee plus any required spaces for ofce or similar use, plus one space for each company vehicle and equipment stored outdoors). Parking calculations have been revised. 4) ft rtv Boundaries. The entire site area within the County needs to be shown on sheet C-2, the side of the property is not shown current# and this area is used to access the loading area within the Cit}'. The entire site is shown on sheet 3 of the plans. 5) Kent Street Frontage. On sheet C-2, the following needs to be provided sidewalk along Kent Street, curb and gutter along Kent Street and the landscaping. These improvements need to be continued to the property line as indicated on sheet C-2. We have added a note regarding improvements to the site and what will be required for future site plan approvals. Maidens JiIMIM/kf Enclosure Candice Perkins From: Candice Perkins Sent: Monday, December 21, 2009 8:26 AM To: Eric Lawrence Subject: Rich Foods/Sunshine That site plan on my chair is very interesting, Patrick and Jeremy pretty much validated a parking lot for Rich Foods that was established in violation of our ordinance. Due to this I imagine that we don't want to pursue that issue anymore. As far as the Kent Street improvements: That site plan from 2002 is more than five years old and therefore is no longer valid. Site plans are valid for five years, and when a site plan is submitted it must meet all requirements of the Frederick County Code per §165-803.04 (Required Improvements). Sidewalks are now part of our current code requirement and curb and gutter is a VDOT requirement that they will comment on. Parking lot landscaping (shrubs along the Kent Street frontage and the trees) are also required. Furthermore, our vested rights policy states that "all requirements provided on an approved site development plan shall be valid for five years from the official approval date of the plan". If we really wanted to "go there" our non conforming policy states: "Such nonconforming uses, structures, and signs shall conform to all laws in effect at the time when the use, structure, and signs were established". This parking area was established sometime between 1981-1988 and the Zoning Ordinance in effect from 1973 through 1989 required site plans for parking area and required a surface material of double prime and seal. So it appears that a site plan was never submitted/approved for the parking lot associated with Rich Foods. I went through site plans from the 80's through today and couldn't find one. So the argument that they are vested/grandfathered in anything is void because it seems that the parking lot is in complete violation because it was never actually permitted. The history appears to go as follows: The 1981 and 1988 aerials show the same building footprint. There appears to be a parking area under what is now the portion of the building constructed in Frederick County (appeared sometime between 2001-today). That building took out that hard surfaced parking area. The gravel parking area as it appears today seems to began taking shape around the mid to late 80's. The 1988 aerial shows a very similar size format to what is there today but there has been much more clearing and gravel added to what appears today. In prepping information to respond to your email to Mark earlier in the week, we have found an issue that needs resolution; hopefully you have the documented answers. As evidenced by review of aerials, and county records.... Prior to 1981, the County portion of the site was wooded. A small parking lot arrived within the County portion of the site in the mid 80s without a county approved site plan. By 2001, a small building addition was constructed which extended slightly in to the County; the parking area also expanded (no site plan approval). By 2006, another building addition entirely within the County was constructed, and parking area continued to expand (no site plan nor building permits issued by County). So it appears we have some significant issues that need resolution. Appears that the parking area was established without County approval, as was the more recent building additions. We'll continue to review materials, but these issues create a more significant issue than the road frontage discussion. Kent Street Winchester, Virginia 22601 RE: Sunshine's Pride Dairy— Site Plan 801 N Kent Street Dear Mark: The proposed site plan for Sunshine's Pride Dairy will use the existing structure located at 801 N. Kent Street for a proposed cheese mariufacturung facility. The property is currently zoned M-1 (Light Industrial). 'Iine proposed use as a cheese manufacturing facility is permitted as a by -right use in the M-1 Zoning District under SIC Code 202 per the Frederick County Zoning Ordinance. The previous use, manufacturing processing and storage were also permitted uses. As such, the proposed use of the site is permitted by right rather than a continuation of a legally non -conforming use. 'I1nc recently submitted site plan for the Property seeks to add a total of four (4) outdoor storage silos at the rear of the building and construct awnings to cover delivery trucks at the existing loading areas. These improvements meet all applicable ordinance requirements of the M-1 Zoning District. Only two of the proposed silos are actually located in Frederick County. There are elements of the site improvements located on the Property that do not meet the current site plan ordinance requirements. These are: - Building Setback - Parking Lot Surface Treatment - Landscaping - Kent Street Improvements (Curb and Gutter) Section 165-901 of the Zoning Ordinance addresses non -conforming uses, structures, and signs. This section of the ordinance would not apply to the use of the site as the use is by -right, as established above. The definition of use, per the Zoning Ordinance, is "any purpose for which a lot or structure may be designed, arranged, intended, maintained or occupied or any activity, occupation, business, or operation carried on a parcel of land". The site features listed above do not satisfy the "use" definition and therefore these elements should be permitted to remain in a legally non -conforming status as they are a pre-existing condition of the site. We feel the improvements depicted on the proposed site plan for Sunshine's Pride Dairy addresses all improvements required by the Zoning Ordinance. Due to the fact that we are not increasing the existing degree of non-conformance for the above specified site features, we do not feel that frontage improvements along Kent Street or additional landscaping for the parking lot area should be required. We believe there are numerous instances in the County where, building additions, or mechanical upgrades, have been made to conforming industrial properties in the County and there has been no requirement that the non standard site features be upgraded to the County standard. Certainly in this case, the addition of two P� R/� silos at the edge of the building near the loading dock would not key parking lot - L and road frontage improvements.
