FLH and its successors and assigns shall have the right to use the land which is subject to the FCSA water easements acquired herein in any manner which shall not interfere with the use and enjoyment of said rights by FCSA. FLH and its successors and assigns shall at all times have the right to cross over and upon the said easements and to use the surface over the easements in such manner as will neither injure nor interfere with the operation or maintenance of the water line, except that no building or other structure shall be erected over the easements unless by written consent of FCSA or its successors; provided, however, that fences, streets or parking areas and improvements ancillary thereto shall be permitted. Whenever the enjoyment of its rights hereunder requires FCSA to disturb the surface over the easements, it shall be the obligation of FCSA to restore the same to its condition prior to being so disturbed, at FCSA's sole cost and expense. We discussed the steps required to get this project through all of its phases, to ensure the proffer requirements are met, and a future opening date would not be delayed. The County provided you an overview of the proffer requirements of this project which are assigned to the property and are to be constructed and in place prior to an issue of certificate of occupancy in a letter dated September 9, 2009. On October 27, 2009, Josh deButts of Pine Knoll Construction sent an e-mail to you and Gregory Hoffman of VDOT stating that there are three taps required (2 sanitary sewer and 1 water main) related to Parcels 2 and 3. These taps will need to be made before the proposed turn -lane along Senseny Road can be completed. Since neither Pine Knoll Construction or KBR/JEM (the developer) is responsible for the taps, Josh is requesting a solution to the problem. Mr. Hoffman responded that VDOT does not want the turn lane installed only to have the new asphalt disturbed for installation of the taps. Therefore, the taps should be made and stubbed out prior to turn lane construction. Failure to comply with this requirement could hamper final completion and release of the land use permit surety bond with VDOT. It is the responsibility of KBR Corporation, to ensure all of the improvements for this development noted on the approved site plan (site plan 4 12-09), including all of the improvements to Route 657 (Senseny Road) and Route 656 (Greenwood Road) be constructed and in place prior to a certificate of occupancy being issued.
