The Frederick County Department of Planning and Develop►nent administratively approved the above -
referenced site plan on November 13, 2009. The site plan is approved for the construction of a test
enclosure located at 390 Airport Road in the Airport Business Center in the Shawnee Magisterial
District.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with three copies
of the approved site plan. Please forward these copies to the appropriate representative(s). Furthermore,
advise the owner(s) that a copy should be kept for future reference, and an approved copy must be kept on the
construction site throughout the development process. Once site development is complete, the owner(s)
should contact this office to schedule an on -site inspection. Do not hesitate to contact me if you have any
questions.

structure, is hereby granted. This extension allows for testing of winter weather conditions on the
temporary test structure. The building permit extension will expire on March 30, 2010.

Subject: Extension of Temporary Test Enclosure at 180 Admiral Byrd Drive,
Winchester, VA
Dear Mr. Cheran,
With your support, we have successfully completed the initial construction test
on the above referenced temporary structure.
Our original plan, as presented to you, was to demolish and clear the site by
October 31St. However, we recognize the tremendous advantage of exposing the
test structure to snow and winter conditions for further evaluation. Based on this
cold weather requirement, we request extending our building permit to March
30, 2010.
Kindly find attached the landowner's agreement for this time extension.

']'his letter is to provide written confinnation of Airport Business Park, LLC's ("Owner") consent
to MiC industries' (J•IIC) request to install concrete liotings and a 150 loot by 30' metal arch
( Improvements) on the property shown on the attached Exhibit A (the -Land")
Owner's consent is conditioned upon the following:
1. All construction and subsequent removal of the improvement's shall be at NIIC's sole cost and
expense.
2. MIC shall remove the Improvements and return the Land to its original condition on or before
March 30. 2010.
3.:N-11C shall remove the Improvements upon Landlord's request, prior to ,March 30, 2010, if in
the reasonable opinion of Owncr the Improvements interfere with operation of file Land or
adjacent property, including but not limited to interference wvith the repair of utilities or storm
water management.
4. MIC shall immediately remove the Improvements il'so directed by any authority having
jurisdiction.
5. MIC shall indemnify and hold Owner hamdess from and against any and all claims arising
Rom (i) the breach of this Agreement, (ii) the presence on the Land of the Improvements, and
(iii) the acts or omissions of MIC. its employees, agents. contractors, subcontractors or invitees.
MIC shall further indemnify and hold Owner harmless from and against all damage or liability
arising out of the activities associated with securing (or failure to secure) any and all permits for
the construction and removal of the lntprovenicnts and for failure to abide by government
requirements.
0. Tenant shall be responsible to secure any permits required for the lawful construction of the
Improvements.
