Dear Ben:
This letter is regarding the meeting we had February 26, 2010, concerning the Walgreens site
plan approval. The site plan will be reviewed and approved to move the project forward;
however, no building permits or land disturbance permits will be issued until following items
have been completed:
1. POA for the adjacent property owners needs to be signed.
2. A shared buffer agreement needs to be in place.
3. Plats of Boundary Line Adjustments (BLA) and easements need to be recorded.
4. All Zoning Ordinance requirements regarding site plans need to be complied with.

The above -referenced site plan was approved on March 4, 2010. The site plan is
approved for the construction of a new Walgreens located at the corner of Route 7 and
Valley Mill Road in the Redbud Magisterial District. Required site improvements
include the following:
• Construction of a parking lot with 74 spaces (including three handicap
accessible), including curb and gutter, striping, and handicap access.
• Construction of an internal private road from Valley Mill Road to Route 7.
• One loading space and a screened dumpster area.
• One freestanding monument business sign.
• A bicycle/pedestrian path along Route 7 and Valley Mill Road.
• Landscaping and buffers as indicated on sheet 5 of the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the
approved site plan, including review agency comments from all relevant review agencies.
I am providing you with six (6) copies of the approved site plan. Please forward these
copies to the appropriate representative(s). Furthermore, advise the owner(s) that a copy
should be kept for future reference, and an approved copy must be kept on the
construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do

4-!e have received your email of the revised site plan dated February 26, 2010 for the
subject project. It- appears all of our earlier review continents have been satisfactorily
addressed. Please advise the owner of our approval. Also please provide six (6) sets of
approved construction plans with signed seal for VDOT distribution.
The appropriate land use permit for roadway improvements may now be applied for to cover
work within the Routes 7, 659 and 716 rights -of -way. The permit is issued by this office
and will require a minimum processing fee and surety bond coverage. Once satisfactory
application has been made, a permit will normally take approximately thirty days to
process and issue.
We anticipate the land use permit for the grading and landscaping along Route 716 being
issued early next week.

Dear Joanne:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues
in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please
review Staff's comments listed below and then prepare a revised site plan which adequately addresses
each concern.
Review Comments:
1. Lot Consolidations/BLA. Consolidations and BLA's need to be completed for parcels 5417-1-
9A, 5417-1-9 and 54F-A-30 before the site plan can be approved.
2. Property Boundaries. On sheets 2 and 3, the property boundaries are still unclear. Surveyed
boundaries for existing and proposed parcel lines need to be provided on the site plan (see notes
on sheets 2 and 3). The discrepancy between the RP property and the B2 property needs to be
resolved (if not part of the commercial property, it cannot be counted toward the zoning district
buffer).
3. Valley Mill Road Trail. Per §144-18, the trail needs to be within the VDOT ROW or placed
within a public access easement; an easement is not shown or referenced on the site plan. The
trail should also be extended to the property limits east as indicated on sheet 3. The crosswalk at
the Route 7 entrance needs to be shifted to align with the path.
4. Adjoining Properties. All adjoining property information needs to be shown on sheets 2 and 3.
Also, the adjoining residential properties are zoned RP, not RA.
5. Zoning District Buffers. Label the active and inactive portions of the buffers on sheet 3. The
shared buffer shown with the Burns' property needs be recorded before the site plan can be
approved. The fence needs to be taken to the property line as indicated on sheet 5. Also, the
zoning district buffer requirements have been revised to allow for the use of shrubs.
6. Interparcel Connection and Access Easement. The interparcel connection to the Burns'
property needs to be constructed to the property line. The limits of the access easement are also
unclear as indicated on sheet 3.
7. Dairy Corner Closure. Provide a notation regarding the closure of Dairy Corner Place.

separated parking lot) needs to be revised. Per § 165-201.01 A(6), no more than five percent of the
required parking spaces may be located at the rear of a building; therefore only four parking spaces
can be located at the rear of a structure that has no public access at the rear or side of the structure.
