Dear Gary:
The above -referenced site plan was approved on April 9, 2010. The site plan is approved for an
Islamic Center located at 420 Stephenson Road in the Stonewall Magisterial District. Required
site improvements include the following:
Use of two existing structures as a meeting area and prayer room.
Construction of parking areas with 17 paved and striped parking spaces (including one
handicap accessible), paving of all travel lanes with tar and chip.
Landscaping as shown on sheet 2 of the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site
plan, including review agency comments from all relevant review agencies. I am providing you
with three (3) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this office
to schedule an on -site inspection. Do not hesitate to contact me if you have any questions.

party of the first part, hereinafter referred to as Grantor, and VIRGINIA
DEPARTMENT OF TRANSPORTATION ("VDOT"l, an agency of the
Commonwealth of Virginia, party of the second part, hereinafter referred to as
Grantee.
WITNESSETH
WHEREAS, the Grantor is the owner of a tract of land described as 3.045
acres, located on Stephenson Road, in Stonewall Magisterial District, Frederick
County, Virginia, Tax Map No. 44-(A)-129, as shown on the plat of Gary R. Oates,
L.S., dated January 29, 2010, a copy of which is attached hereto and by this
reference made a part hereof; and being the same property conveyed to the Grantor
by Deed of Gift dated July 22, 2008 and recorded in the Clerk's Office of the
Circuit Court for Frederick County, Virginia as Instrument No. 080008873; and
WHEREAS, it is the desire and intent of the Grantor to dedicate to VDOT
for public use that portion of the property set forth on the attached plat described
as "5' RIW Dedication" and "10' R/W Dedication".
NOW, THEREFORE, for good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, the Grantor does hereby grant and
convey in fee simple unto VDOT and dedicate for public use that portion of the
property set forth on the attached plat described as "5' R/W Dedication" and "10'
R/W Dedication".

Attached is a revised copy of the site plan with your comments addressed below.
1. The general notes have been revised per your comment.
2. The parking phases have been removed and all parking spaces will be
constructed at one time as requested.
3. There has not been any right of way dedication proposed. The lot has been
subdivided, boundary line adjustments, etc. in the last few years and neither
the County nor VDOT has requested any dedications. Also, I met with Lloyd
Ingram and Matt Smith prior to submitting these plans and they did not ask
for any additional right of way. VDOT has approved this plan.
4. The BRL's have been labeled per your request.
5. I have labeled the driveways and parking spaces to be covered by tar &
chip. The additional gravel areas will have topsoil and seeding applied.
6. As I have already discussed with you, the entrance onto Stephenson Road
cannot be closed since there is a shared easement with a neighboring
parcel. The shared ingress -egress easements are not restricted by use.
7. The existing trees have been labeled by species and their caliper indicated.
Evergreen shrubs have been added to the parking spaces facing the public
roads, The five spaces on the western side of the driveway faces the existing
shed and garage, those structures will block headlights from shining onto
the neighbors.
8. A dumpster will not be needed or shown. However, general note #3 will
require screening should they ever decide to place one on the property.
9. All outdoor lighting with be decorative single bulb units with 60 watt bulbs.
Notes have been added to prevent nuisance lighting from being added later.

Dear Gary:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues
in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please
review Staff's comments listed below and then prepare a revised site plan which adequately addresses
each concern.
Review Comments:
I. Coversheet General Notes. Provide the standard lighting, utility and dumpster notes on the
coversheet. Provide the maximum occupancy load for the two structures as well.
2. Parking Phases. It is unclear how the center will be phased, as all the buildings where the
proposed uses will take place are existing structures. Also, the site plan does not show what
buildings go with Phase 1 and Phase 2. It appears that since the structures are existing, the entire
parking area needs to be constructed at one time.
3. Stephenson and Gun Club Roads. Indicate on the site plan if ROW dedications are needed.
4. BRL's. Label the BRL's.
5. Parking Lots. The use of gravel for the parking lot is not permitted; the surface of the parking
lot and travel lanes needs to consist of a material that provides a durable, dust and gravel -free,
hard surface. There are also large gravel areas that are not designated as parking spaces. These
areas need to be removed to ensure they are not used as overflow parking areas or designated as
parking.
6. Site Entrance. The entrance on Stephenson Road should be closed and the GUIl Club Road
entrance should solely be used. Ensure that the recorded shared access can be utilized for uses
other than residential.
7. Landscaping. Label the species of the existing trees and provide their caliper, and provide
evergreen shrubs as indicated on sheet 3. Revise the parking lot landscaping tabulation as
indicated on sheet 2.
8. Dumpstei• Location. Indicate if a dumpster will be provided.
9. Site Lighting. Indicate if any outdoor lighting will be provided.
