Dear Niki:
The above -referenced site plan was approved on May 10, 2010, for the construction of outdoor
storage and construction of an eight foot in height fence. However, per the Zoning
Administrator's letter dated April 28, 2010, implements of the approved site plan must be met
no later than June 30, 2010.
I am providing you with three (3) copies of the approved site plan. Please forward these copies
to the appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept
for future reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this
office to schedule an on -site inspection. Do not hesitate to contact me if you have any questions

Dear Mr. Rodgers:
This letter is in reference to Site Plan 929-09 for the Pro -Lawn property located at 280 Victory Road
that was submitted to Frederick County on August 31, 2009. This site plan was submitted in
response to a zoning violation complaint received by this office for outdoor storage on July 28, 2009.
This site has not been approved or accepted as is required by the Frederick County Zoning
Ordinance. In order for the site plan to be accepted and approved, a landscape screening of staggered
evergreens around the outdoor storage area needs to be implemented. A chain -link fence with slits
does not meet the screening requirements of the Frederick County Zoning Ordinance. This was
conveyed by my staff via e-mails and meetings with you and your engineer.
This office will allow you until May 10, 2010, to submit a site plan for approval by Frederick
County, with the completion of the landscape screening of staggered evergreens around the outdoor
storage area as required by the Zoning Ordinance. You will be required to implement the site plan
improvements no later than June 30, 2010. Failure to complete the site plan improvements by this
date, thus resolving this zoning violation, will result in a criminal complaint being filed against you.

Per our discussion yesterday 04/26/2010 it was agreed that the proposed slats would be
acceptable for the gate only and not to be used as screening for the rest of the fencing. Mr.
Rodgers has two options, put board on board screening for the rest of the existing fence and
or implement a chain link fence with two rows of evergreens. Also, the cover sheet of site
plan needs to be corrected with proper information, such as address, use, and title(Fort
Collier Industrial Park?) Please make these corrections. The Zoning Administrator is sending
a letter to Mr. Rodgers and he is carbon copy you on the letter as well giving Mr. Rodgers 30
days to implement site plan or legal action will be taken. Any other questions that you have
please do not hesitate to contact me. Thanks Dana.

As discussed, we have met the screening requirement by planting two row of evergreen (Leyland Cyprus) at 10' on
center. You indicated there is a need for additional screening for the gates portion where there are no planting behind the
chain link fence. I concur with that and we would like to add some type of solid screening on this area see link below.
There are three screening option:
1. Slat link (this product does not provide enough screening)
2. Privacy Master
3. Privacy Link both of these products number 2 and 3 will suffice to meet the screening requirement. see attached jpeg
pictures. This even better then Opaque fencing, see link below

this material to be utilized for the outdoor storage gates only. This product will not be permitted for any other outdoor
storage area screening (use of board on board fence, berm, or evergreen screen will still be required) and it will not be
permitted for dumpster screening or dumpster gates.

You must be thinking of slat link see attached picture slatlink. I am completely agreed with you, slat link does not meet the
the screening purposes nor function as opaque fence.
Please check the privacy master or privacylink both of these products meet the screening purpose and function as an
opaque fence. If we utilizing the green forest color that will blend in with our proposed Leyland Cyprus.

A chain link fence in conjunction with the staggered evergreen screening is acceptable around the outdoor storage area,
however the options for the gate are not. Chain link with slats is not permitted and another option will have to be
looked at. These products have not been installed in Frederick County since the ordinance prohibits them.

Dear Niki:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site plan
is denied until the issues in this letter, as well as all issues of the other review agencies, have
been adequately addressed. Please review Staffs comments listed below and then prepare a
revised site plan which adequately addresses each concern.
Review Comments
1. Site Plan. Provide a cover sheet that reflects all the necessary blocks per code. Also,
change page numbers to show sheet I and 2.
2. Fencing. Chain link fences are not permitted by code. Opaque fencing is required.
Adjust all sheets to reflect these changes, including details.
I Tree Chart. Provide an addition block in chart to annotate ten feet spacing between
trees on center.
After you have revised the site plan, please resubmit two copies so that I may verify the
information contained on the plan. Do not hesitate to contact me if you have any questions or
