The above -referenced site plan was approved on July 19, 2011. This site plan is approved for revisions to
the existing Salvation Army property located at 300 Port Collier Road in the Stonewall Magisterial
District. Site improvements include a 1,041.6 sf building addition, dumpster relocation, and a 1,152 sf
pavilion.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments From all relevant review agencies. 1 am providing you with six (6)
copies of the approved site plan. Please forward these copies to the appropriate mpresentative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to

Memorandum
We had previously submitted plans for a kitchen addition and picnic shelter at the Salvation Army facility.
We had addressed County comments and were only lacking the buffer easement for the adjoining property. I
have attached a copy of the recorded easement as well as site plans for approval.

WIdEREAS, The Salvation Army owns certain property in Frederick County, Virginia
identified as Tax Map Parcel 54-A-36F, zoned B2 (General Business); and
WHEREAS, Winchester Warehousing, Inc. owns certain property in Frederick County,
Virginia identified as Tax Map Parcel 54-A-73, zoned M2 (General Industrial); and
WHEREAS, Section 165-203.02 of the Zoning Ordinance as contained in the Code of the
County of Frederick, Virginia (hereinafter "the Zoning Ordinance"), establishes certain requirements
for buffers and screening, with particular attention to adjoining lands in different zoning districts;

WHEREAS, Section 165-203.02D(9) ofihe Zoning Ordinance permits adjoining owners of
properties in different zoning districts to establish common shared buffi- rs; and
WHEREAS, the parties have agreed to cooperate in establishing such a common shared
buffer for the mutual benefit of then properties, and wish now to memorialize that agreement,
NOW THEREFORE, for and in consideration of the mutual promiscs herein exchanged, and
the sum of one dollar ($1.00) by each party paid to the other, receipt of which each party hereby
acknowledges, the parties agree and take action as follows:

1. The Salvation Army hereby grants and conveys to Winchester Warehousing, Inc. any

easement over the Salvation Army property, the location of said easement being more particularly
described as any portion of the "25' COMMON SHARED BUF ER" located onthe Salvation Army
property on that certain exhibit entitled "Exhibit Showing 25' Common. Shared Buffer on and
through Property of The Salvation Army and Winchester Warehousing, Inc." as prepared by Patton
Harris Rust and Associates and dated May 19, 2010. This easement is granted for the purposes
described below.
2. Winchester Warehousing, Inc. hereby grants and conveys to The Salvation Army an
easement over the Winchester Warehousing, Inc. property, the location of said easement being -more
particularly described as any portion of the "25' COMMON SHARED BUFFER" located on the
Winchester Warehousing, Inc. property on that certain exhibit entitled "Exhibit Showing 25'
Common Shared Buffer on and through Property of The Salvation Army and Winchester
Warehousing, Inc." as prepared by Patton Harris Rust and Associates and dated May 19, 2010, which
exhibit is attached as Exhibit 1 hereto and incorporated herci o. This easement is granted for the
purposes described below.
3. The purpose of the proposed mutual easement herein created is to create a common
shared zoning district buffer as permitted by Section 1.65-203.02D(9) of the Zoning Ordinance. The
25' Common Shared Buffer as shall utilize existing vegetation to satisfy the screening requirements
of the Zoning Ordinance and to enable the shared buffer to be 50% the width otherwise required
when existing vegetation is not utilized as permitted by the Zoning Ordinance.
4. The Salvation Army agrees to be responsible for the maintenance of any portion of
the 25' Common Shared Buffer located. on the property owned by the Salvation Army.

5. Winchester Warehousing, Inc. agrees to be responsible for tlne maintenance of any
portion of the 25' Common Shared Buffer located. on the property owned by Winchester
Warehousing, Inc.
6. No disturbance of the existing vegetation located within the 25' Common Shared
Buffer area is permitted by The Salvation Army and/or Winchester Warehousing, Inc. without the
express written consent of the Zoning Administrator for Frederick County, Virginia.
7. Should the Zoning Ordinance, or the zoning of either parcel, change so that a common
shared buffer becomes unnecessary, or so that the burden thereof may be reduced without harm to
either owner, the parties agree in good faith to meet and consider a modification agreement for that
purpose.
8. The obligations contained herein shall be. binding on The Salvation Army and
Winchester Warehousing, Inc., their successors and assigns. The burdens herein created shall run
with each parcel, for the benefit of the other parcel, in perpetuity.
This mutual grant of easement is made in accordance with the desires of The Salvation Army
and Winchester Warehousing, Lac.

Buildings shall comply with The Virginia Uniform Statewide Building Code and section 303 -
A,Assembly Use Group and Section 304 B, Business Use Group of the International Building
Code/2006. Other Code that applies is ICC/ANSI Al 17.1-03 Accessible and Usable Buildings

We have also added a note that would allow for the proposed pavilion to be constructed following site plan
approval but would require the conunon shared buffer to be recorded prior to issuance of a building pernut for
the proposed building addition. This note would allow for Salvation Army, to proceed with construction of the
Pavilion next Tuesday but ensure that the buffer is recorded prior to expansion of the existing building nearer
the property line.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be granted.
At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as
well as all issues of the other review agencies, have been adequately addressed. Please review Staffs comments
listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) Zoning District Buffer. The proposed 50' zoning district buffer on the adjoining property needs to be
recorded as a 50' reduced distance common shared buffer and revised as indicated on the plan.
2) Surveyed Boundaries. The surveyed boundaries for the site need to be provided.
3) Notes. The signage note (#2) needs to be revised, provide a notation that no new parking is required, and
provide a note that no additional site lighting will be provided.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained on the
plan. I will need all approved review agency comment sheets and at least five copies of the fmal plan for approval.
Comment sheets are required from the following agencies: the Frederick County Inspections Department, the
Frederick County Fire Afarshal, and the Frederick County Health Department.
