Kim,
Based on our meeting at the site, the berms installed on the site appear to meet the intent of the required zoning
district buffer fence element. Therefore the board on board fence will not be required, only the required landscaping
needs to be installed.

Would you please verify, as discussed during the site visit of September 10th that you and Mr. Eric Lawrence
Director of Planning for Frederick County, that due to the existing conditions of the berms surrounding the new parking
lot there is no need for the board fence in the category "C" buffer. The vegetation for the buffer would still be required
to satisfy the county's planning and zoning ordinances.

Dear Jeremy:
The Frederick County Department of Planning and Development administratively approved the
above -referenced site plan on July 17, 2009. The site plan is approved for a new parking lot at the
Facility located at 170 Marcel Drive in the Shaw11CC Magisterial District. Required site
improvements include the folloNving:
• COI1St1-LICt1011 of a new parking lot with 122 spaces, 111CILldlllg curb and gutter, striping
sidewalks and landscaping (site will have a total of 577 spaces, including 12 handicap
accessible spaces).
• Buffers and landscaping as shown on sheet 5 of the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. 1 am providing you with
seven (7) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owller(s) that a Copy should be kept for future reference,
and an approved copy must be kept on the construction site thl'OughOLlt the development process.
Once site development is complete, the owners) should contact this office to schedule an On -site

Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This
site plan is denied until the issues in this letter, as well as all issues of the other review
agencies, have been adequately addressed. Please review Staffs comments listed below
and then prepare a revised site plan which adequately addresses each concern.
Review Comments
1. Special Limited Power of Attorney Form. Please have the property owner sign
the attached Special Limited Power of Attorney Form prior to further review or
approval. This form should be notarized and completed to grant the applicant
(you) with authorization to represent them for this site plan.
2. Current Use. Revise the current use as indicated on the coversheet.
3. Parking Spice Number. Revise the parking calculation on the coversheet to
show 581.
4. Handicap Spaces. On sheet 3, it is unclear where the I -IC spaces are being
provided.

The Frederick County Department of Planning and Development administratively approved the
above -referenced site plan on July 17, 2009. The site plan is approved for a new parking lot at the
facility located at 170 Marcel Drive in the Shawnee Magisterial District. Required site
improvements include the following:
Construction of a new parking lot with 122 spaces, Including curb and gutter, striping,
sidewalks and landscaping (site will have a total of 577 spaces, including 12 handicap
accessible spaces).
Buffers and landscaping as shown on sheet 5 of the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with
seven (7) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future reference,
and an approved copy must be kept on the construction site throughout the development process.
Once site development is complete, the owner(s) should contact this office to schedule an on -site
inspection. Do not hesitate to contact me should you have any questions or concerns.
