Subject: Permitted Signage in Frederick County and the Kernstown Commons Development Date: June 18, 2009 On February 13, 2008, the Board of Supervisors approved changes to the signage regulations contained in Chapter 165-Zoning. These changes mandated the use of monument style signs in Frederick County, revised the signage height and size to be based on road classifications, and added provisions for electronic message signs. The revisions also included provisions for the use of multi -tenant complex signs as well as additional signage when multi -tenant complex signs are utilized. Frederick County administratively approved the final master development plan for Kernstown Commons on July 6, 2005. This MDP stipulated that the site was restricted to the use of monument style signs, but did not indicate the total number of signs the site was permitted to have. Subsequently, a site plan for the development was approved on July 29, 2005; this plan showed four proposed sign locations along the Route I 1 frontage. Only the Outback Steakhouse and the hotel were constructed under this site plan and two of the four proposed monument signs. The two monument signs constructed were both multi -tenant complex signs. Under the 2008 sign ordinance change, the Kernstown Commons Site would be permitted to have two multi -tenant complex signs with a maximum height of 25 feet and a maximum area of 150 square feet. The ordinance stipulates that all additional freestanding signs cannot be larger than 12 feet in height and 50 square feet in size. On June 24, 2008, a revised site plan for portions of Kernstown Commons was approved (revised on October 30, 2008, and portions revised again on February 24, 2009); these plans did not include Lot 2 of this development which has never been site planned. With the approval of these plans, it was expressed through comment letters that the additional signage was not permitted due to the ordinance revisions approved in 2008 and the additional signage was removed and the plans approved. In May of 2009, a site plan for Lot 2 of Kernstown Commons was submitted that contained the additional freestanding sign (20 feet in height and 150 square feet in size). The engineer was informed that this signage was not permitted because the site already had two multi -tenant complex signs and all other freestanding signage was restricted to 12 feet in height and 50 square feet in size. Lot 2 of Kernstown Commons is permitted to have signage area on the two existing Kernstown Commons multi -tenant complex signs currently located at each of the Route 11 entrances. The lot is also permitted to have one freestanding business sign that is 12 feet in height and 50 square feet in size as well as building or wall mounted signage and canopy signage as permitted by the Zoning Ordinance. Wall mounted signage is permitted to encompass 20% of the area of the wall that the sign is attached to, provided that the total area of the sign does not exceed 200 square feet. Required site improvements include the following: • 5,700 square foot building (3,600sf convenience store/2,100sf retail/restaurant). • Gasoline Station with 5 pumps (10 stations) and a carwash. • Construction of a parking lot with 50 spaces (including two handicap accessible), including curb and gutter, striping, handicap access, sidewalks and landscaping. • One loading space and one screened dumpster location. • Route 1 1 improvements and the 10 foot asphalt trail along Route 1 I to be completed before the issuance of the certificate of occupancy. All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan, including review agency comments from all relevant review agencies. I am providing you with five (5) copies of the approved site plan. Please forward these copies to the appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy must be kept on the construction site throughout the development process. At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review Staffs comments listed below and then prepare a revised site plan which adequately addresses each concern. Review Comments: 1) Lighting Plan. We have revised the note accordingly. 3 Comment: Parking Calculations. The parking calculations and site information need to be moved from sheet 4 to sheet 2. Response: Complied. The location of the parking calculations has been revised and the revisions have been made as noted on the plan. We have labeled the use of the 1800 sf portion of the building to be "Retail/ Restaurant and revised the calculation to be for 1 space per 100 sf of floor space. The total number of spaces provided is still greater than that require. 4 Comment: Site Information. On sheet 2 provide the building height (Structure and Canopy) and the minimum and provided setbacks. Response: Complied. We have added the required information to the site plan. 5 Comment: Route 11 Improvements. A note needs to be provided on the site plan that the Route 11 improvements need to be completed before any certificate of occupancy is provided for the site. Response: Complied. We have added a note to the plan near the existing notes regarding the Rt.11 improvements. 6 Comment: Lighting Plan. A lighting plan needs to be included that shows the type of lighting to be used on the site. Details of any wall mounted, pole lights and canopy lighting need to be provided in the site plan. Response: Complied. We have added the location and specification for the lights to be used for this project. Building wall mounted lighting notes have been added and specific shall be included with the architectural plan for the building. Kernstown Commons —Lot 1 • • Page 2 of 3 7 Comment: Signage. The MDP for the site plan restricted freestanding signage to two multi -tenant signs that have already been constructed. Lot 1 is permitted to have one free standing sign not to exceed 12 feet in height and 50 sf in size. Response: The sign detail aligns with the ordinance which was in place at the time of master plan approval stating the maximum height of 20' and sign area of 150 square feet. Due to circumstances beyond the control of the developer, lot 1 would have been developed prior to new zoning regulations in 2008 restricting signage on this lot. We feel the current regulations adversely affect signage for the use proposed on this lot. 8 Comment: Entrance Alignment and Configuration. The full entrance needs to be adjusted to align with the parking lot entrance as indicated on sheet 3, and the right out need to be designed to prohibit entrances. Response: We have acknowledge your comment however, we offer the following the following alternative. We have added a striped area to separate the required stacking for the carwash. This will allow cars to exit the line if desired. Also, by leaving the pavement as initially designed the stacking for the carwash is offline from entering vehicles. 9 Comment: Sidewalk. Revise the sidewalk as indicated on sheet 3. Response: Due to the location of the Limited Access Fence, we are unable to comply with your request. VDoT has reviewed the plan and does not have issue with the location next to the curb other than to make the sidewalk 6' wide in that area. We have revised the width of the sidewalk adjacent to the curb to 6' wide from the back of the curb. 10 Comment: Handicap Ramp. A HC ramp needs to be provided on the sidewalk adjoining the structure. Response: Complied. We have provided the detectable warning surface as well as providing the pavement to be at the same elevation of the sidewalk in this area. 11 Comment: Site Paving. It appears that some of the site paving can be reduced by narrowing pavement width between the carwash and the parking area, reducing the travel aisles to 24, and reducing the primary entrance to 36 feet instead of 40 feet. Response: Thank you for the suggestion to reduce the travel areas. We have discussed this option and we respectfully inform you we will be keeping the pavement area as originally shown. 12 Comment: Directional Arrows. Directional arrows need to be provided throughout the development. Response: Complied. We have added directional arrows near the site entrance and a striped area to separate the carwash stacking from the other areas of the site. 13 Comment: Carwash. Show the stacking area (minimum 90 feet) for the carwash. Response: Complied. We have shown the stacking area for the carwash. 14 Comment: Dumpster Location. It appears that the dumpster should be relocated to the rear of the structure, adjacent to the loading space, If kept at the proposed location, a six inch concrete curb needs to be provided between the dumpster and the parking space with a separation of at least three feet (165-27E(9)). Response: We have left the dumpster in the originally proposed location and have added the curbing as necessary to provided separation to parking spaces. Some of the areas shown as interior green space on sheet 3 are perimeter green space, not interior. Response: Complied. We have revised our landscaping calculations to eliminate the area in question and have added green space next to the carwash between it and the convenience store and added a curb island along the RT.11 row parking area. 16 Comment: Tree Locations. Four trees need to be relocated as indicated on sheet 4 due to conflicts. Interior trees need to be provided within the islands surrounding the structure. Response: The trees you have indicated are serving two purposes. The primary purpose is use with the Terrafilter storm water quality system and the secondary is for landscaping requirements. Perkins, ATCP, Senior Planner, Subject: Permitted Signage in Frederick County and the Kernstown Commons Development Date: June 18, 2009 On Febmary 13, 2008, the Board of Supervisors approved changes to the signage regulations contained in Chapter 165-Zoning. These changes mandated the use of monument style signs in Frederick County, revised the signage height and size to be based on road classifications, and added provisions for electronic message signs. The revisions also included provisions for the use of multi -tenant complex signs as well as additional signage when multi -tenant complex signs are utilized. Frederick County administratively approved the final master development plan for Kernstown Commons on July 6, 2005. This MDP stipulated that the site was restricted to the use of monument style signs, but did not indicate the total number of signs the site was' permitted to have. Subsequently, a site plan for the development was approved on July 29, 2005; this plan showed four proposed sign locations along the Route 1 l frontage. Only the Outback Steakhouse and the hotel were constructed under this site plan and two of the four proposed monument signs- The two monument signs constructed were both multi -tenant complex signs. Under the 2.008 sign ordinance change, the KemsWNNm Commons Site would be permitted 'to have two multi-tinant'coniplex signi with a maximum height of 25 feet and a maximum area of 150 square feet. The ordinance stipulates that a]1 additional freestanding signs cannot be larger than 12 feet in height and 50 square feet in size. On June 24, 2008, a revised site plan for portions of Kernstown Commons was approved (revised on October 30, 2008, and portions revised again on February 24, 2009); these plans did not include Lot 2 of this development which has never been site planned. With the approval of these plans, it was expressed through comment letters that the additional signage was not permitted due to the ordinance revisions approved in 2008 and the additional signage was removed and the plans approved. In May of 2009, a site plan for Lot 2 of Kernstowm Commons was submitted that contained the additional freestanding sign (20 feet in height and 150 square feet in size). The engineer was informed that this signage was not permitted because the site already had two multi -tenant complex signs and all other freestanding signage was restricted to 12 feet in height and 50 square feet in size. Lot 2 of Kernstown Commons is permitted to have signage area on the two existing Kemstown Commons multi -tenant complex signs currently located at each of the Route I 1 entrances. The lot is also permitted to have one freestanding business sign that is 12 feet in height and 50 square feet in size as well as building or wall mounted sigliage and canopy signage as permitted by the Zoning Ordinance. Fall mounted signage is permitted to encompass 20% of the area of the wall that the sign is attached to, provided that the total area of the sign does not exceed 200 square feet.
