Dear Randy:
The above -referenced site plan was approved on July 5, 2011. This site plan is approved for
revisions to the Village at Orchard Ridge Development which was previously approved under
Site Plan #42-09. This revised site plan is approved for the construction of a new Continuing
Care Retirement Community (CCRC) located on Lutheran Home Boulevard off of Northwestern
Pike (Route 50 West) in the Gainesboro Magisterial District. Required site improvements
include the following:
- Construction of 51 carriage home/street cottage/alley cottage units.
Construction of 135 apartment units, 19 assisted living units and 28 skilled care units.
Construction of multiple parking areas with a total of 421 spaces, including curb and
gutter, striping, handicap access and landscaping.
Sidewalks, landscaping and site lighting as indicated on the site plan.
Loading spaces and dumpsters as indicated on the site plan.
With the approval of this site plan, it needs to be recognized that road improvements associated
with this development can be found on the Lutheran Home Boulevard PIP approved by VDOT
on September 24, 2010.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site
plan, including review agency comments from all relevant review agencies. I am providing you
with three (3) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this
office to schedule an on -site inspection. Do not hesitate to contact me if you have any questions
or concerns.

Dear Ms. Perkins:
We are in receipt of the comments dated March 15, 2011 for the TVOR site plan revision and offer the
following responses:
Comments from Frederick County Planning
Comment 1: Apartment Building Unit numbers. The number of apartment units listed on the coversheet of the
site plan for Aparhnews #1, 2, 7 and ,\•heal C3-03 do not match. `Phase numbers also do not correspond to Ilia
submitted building permil. The site plan has a discrepant., of f air units between the cover sheet and sheet C.3-
03.
Response: The cover sheet of the plans and Sheet C3-00 has been revised to match. These numbers should
match the architect's building permit.
Comment 2: Neiv Building. There is a neiv building shown on the site plan, (labeled as the skilled care
building on the building permit). This building is not labeled. Label this building and show the number of
residential unils/beds within the building. Indicate if the 10 skilled care emits and 18 assisted living units are
wilhin this building.
Response: YOU are correct. The new Unlabeled building oil the site plait sheet C3-00 Is the skilled cafe blllldlllg.
which we have called the Small HOLISe, as has been the designation when this building came to existence. This
building houses the skilled care and assisted living Facilities. There are 10 beds associated with skilled care and
18 beds associated with the assisted living program. We have labeled Sheet C3-00 with this information as
regUested.
Comment .3: Alternative #1 and #2. A narrative of fliese two alternatives )needs to be provided on the site plan.
It appears that if alternative #2 is constructed, Thal ahernalive I cannot be constructed of if alternative I is
constructed, Then alternative 2 cannot be constructed. Provide a clear understanding of the alternatives and
what is necessar, to construct both alternatives.
Response: We have discussed this item on the phone and have been clarified without need to provide revisions
to the site plait. As an explanation, the alternatives have been added to the plan set as a bidding tool foi' the

owner of the project to determine costs associated with each section. The owner wanted options for pricing,
should the cost of the project cone in under or over budget. The owner intends to build both alternatives and
the site plan approval should be foi' both, however the owner may or may not build these items initially,
depending on the market and costs associated with these alternatives. Regarding Constructability, both options
can be constructed without impact to the other so the owner can chose none, one, or both without impact to the
integrity of the site.
Comment 4: Building 7. On sheet C3-02 label aparhnent building 7 as an alternative.
Response: Building 7 is labeled as Alternate #1 oil Sheet C3-00 as appropriate. Additional information oil the
site plan sheet would Clutter and cover up notes needed for construction, so it wasn't added to that sheet.
Comment 5: Setbacks to Property Lines. For the apartment buildings, common building, and the new building,
setbacks to the properlY lines need to be shown — see sheet C3-00.
Response: Setbacks to the buildings have been provided on Sheet C3-00 as requested. We have only provided
setbacks to the closest Corner along the nearest property line.
Comment 6: Interior Landscaping. On Sheet CIO-02, the interior parking calculation onlY accounts for 353
parking spaces, not 437 as shown on sheet CI -0l.
Response: The parking calCL1latlons have been clarified and corrected on sheets CI-01 and C10-02. The
landscaping CalCLllations and plantings have been modified as appropriate.
Comment 7: Shrubs. On sheet CIO-02 provide evergreen shrubs Cis indicated.
Response: Noted. The shrubs requested have been added to the plan.
Included in this letter package are 2 full sets of the revised plan set based on the comments above. The other
sheets have not been Submitted as they did not need to be revised. We have also attached approvals from FC
Sanitation Authority, FC Inspections, FC Fire Marshal, VDOT, FC Public Works, and FC GIS Department.
Thank you for your assistance with this project. I-lopel'ully this will satisfy the comments by the Planning
Department and allow for final approval of this site plan revision. Please contact us when approved so we can
provide you with the appropriate sets for signature.

Dear Randy:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site plan
is denied until the issues in this letter, as well as all issues of the other review agencies, have
been adequately addressed. Please review Staffs comments listed below and then prepare a
revised site plan which adequately addresses each concern.
Review Comments
1. Apartment Building Unit Numbers. The number of apartment units listed on the
coversheet of the site plan for Apartments #1, 2, 7 and sheet C3-03 do not match. These
numbers also do not correspond to the submitted building permit. The site plan has a
discrepancy of four units between the coversheet and sheet 0-03.
2. New Building. There is a new building shown on the site plan (labeled as the skilled
care building on the building permit), this building is not labeled. Label this building and
show the number of residential units/beds within the building. Indicate if the 10 skilled

Site Plan Revision Rcqucst
Dear Nis. Perkins:
As you are aware, the National Lutheran I tome (NIA 1) is in the process of developing; a CCRC west of the City of
Winchester. This site plan was originally approved by the County on October 15, 2010. Since then there has been a
few changes due to the marketing; process among; other items such as more detailed design information from the
architect and the associated designs team.
Below is a brief breakdown of the changes associated with this site plan revision:
1. The 20-unit Carriage I louse has been removed from the plans (relocated to Phase 2).
2. Alternate #1 has been added to allow NH I to remove building; #7 from scope should marketing dictate.
3. alternate #2 has been added to allow for NH I to add the 20 additional units back to the site as individual
cottages (the alley serve or street serve units). 'These were orignnally slated for Phase 2 but have been moved
to Phase 1.2.
4. The assisted living;/skilled care wing; has been removed from the main building; and located within a "Small
I louse" concept.
5. The space left over from the Al./SC relocation has been filled with ,apartments.
6. The site experienced various design changes based on these changes as well as better coordination with roof
leaders, stormwater collection, parking space calculations, ctc. to ensure a coordinated design with the
design team.
We arc requesting a site plan revision for this project and have submitted this request to all agencies who had
reviewed the original project. Please reyicw and comment as appropriate. Contact us with any questions or need
for additional information.

This is to acknowledge receipt of your revised plans for the referenced project. The plans appear satisfactory
and are approved. Please advise the developer accordingly. Please submit three copies of the signed and sealed
plans for signature, and a CD with PDF's of the individual plan sheets.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with the attendance of the
contractor, various County agencies and VDOT prior to initiation of work.
• Materials used and method of construction shall apply to current observed VDOT Road & Bridge
Specifications applicable during construction of this development.
• Our review and comments are general in nature. Should conditions in the field exist such that additional
measures are warranted, such measures shall be completed to the satisfaction of the Department prior to
inclusion into the Secondary Road System.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a pipe or
drainage easement.

The contractor shall notify VDOT when work is to begin or cease for any undetermined length of time.

• The appropriate land use permits shall be obtained before any work is performed on the State's right-of-

Proposed Site shall comply with The Virginia Uniform Statewide Building Code, Sections 308.2
(I -Institutional), and Section 310.1 (R-Residential) of the International Building Code/2006.
Duplex's and Single family dwellings shall comply with the International Residential Code.
Other Code that applies is ICC A117.1-3-03 Accessible and Usable Buildings and Facilities.
Proposed Apartment building and assisted living facility shall comply with height and area as
specified in Table 503 with applicable increases. Sprinkler requirements per See 903 USBC
2006. Stand alone FDC provided. Locations shall be approved by Fire Marshals office. All
required egress shall be handicap accessible. Handicap parking shall be provided per Section
1106.6 (Where multiple accessible entrances are provided, parking shall be dispersed). Parking
shall be provided as required per Section 1106.2 (2%) and 1106.5 for total van spaces.
Accessible parking and unloading dimensions shall be per ANSI A117.1-03 Section 502.
Signage shall comply with USBC 1106.8. Max 5% slope on accessible walkways. Max 2%
slope on landings. Accessible ramps shall not exceed 1:12. Max run on Accessible ramps is 30'.
Accessible, Type A and Type B residential units shall be provided as required by 1107 IBC
Duplex buildings shall be separated as per International Residential Code Section R317.
Backwater valves shall be installed on all plumbing fixtures, (subject to back sewer), located
